| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 49-g(m), Article III, Texas |
|---|
| 11 | 11 | | Constitution, is amended to read as follows: |
|---|
| 12 | 12 | | (m) In addition to the appropriation authority provided by |
|---|
| 13 | 13 | | Subsections (k) and (l) of this section, the legislature may, by a |
|---|
| 14 | 14 | | two-thirds vote of the members present in each house, appropriate |
|---|
| 15 | 15 | | amounts from the economic stabilization fund to: |
|---|
| 16 | 16 | | (1) retire state debt; |
|---|
| 17 | 17 | | (2) pay costs associated with a state of disaster |
|---|
| 18 | 18 | | declared by the governor; or |
|---|
| 19 | 19 | | (3) pay nonrecurring costs of roadway infrastructure |
|---|
| 20 | 20 | | projects, excluding costs associated with: |
|---|
| 21 | 21 | | (A) toll roads or other restricted motor vehicle |
|---|
| 22 | 22 | | transportation lanes; or |
|---|
| 23 | 23 | | (B) projects, facilities, or accommodations for: |
|---|
| 24 | 24 | | (i) pedestrian or bicycle transportation; |
|---|
| 25 | 25 | | (ii) mass transit; or |
|---|
| 26 | 26 | | (iii) multimodal transportation [at any |
|---|
| 27 | 27 | | time and for any purpose]. |

| 28 | 28 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 29 | 29 | | submitted to the voters at an election to be held November 7, 2017. |
|---|
| 30 | 30 | | The ballot shall be printed to permit voting for or against the |
|---|
| 31 | 31 | | proposition: "The constitutional amendment relating to limiting |
|---|
| 32 | 32 | | the permissible uses of money appropriated from the economic |
|---|
| 33 | 33 | | stabilization fund." |
