| 12 | 12 | Sec. 11d. A person taken into custody for committing a | |
| 13 | 13 | felony shall be denied release on bail pending trial if a judge or | |
| 14 | 14 | magistrate, following a hearing, determines that the person is not | |
| 15 | 15 | a citizen or national of the United States and is not lawfully | |
| 16 | 16 | present in the United States. | |
| 17 | 17 | SECTION 2. This proposed constitutional amendment shall be | |
| 18 | 18 | submitted to the voters at an election to be held November 7, 2017. | |
| 19 | 19 | The ballot shall be printed to provide for voting for or against the | |
| 20 | 20 | proposition: "The constitutional amendment denying bail to certain | |
| 21 | 21 | persons who are unlawfully present in the United States and are | |
| 22 | 22 | taken into custody for committing a felony." |
