55 A JOINT RESOLUTION
66 proposing a constitutional amendment denying bail to certain
77 persons who are unlawfully present in the United States and are
88 taken into custody for committing a felony.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article I, Texas Constitution, is amended by
1111 adding Section 11d to read as follows:
1212 Sec. 11d. A person taken into custody for committing a
1313 felony shall be denied release on bail pending trial if a judge or
1414 magistrate, following a hearing, determines that the person is not
1515 a citizen or national of the United States and is not lawfully
1616 present in the United States.
1717 SECTION 2. This proposed constitutional amendment shall be
1818 submitted to the voters at an election to be held November 7, 2017.
1919 The ballot shall be printed to provide for voting for or against the
2020 proposition: "The constitutional amendment denying bail to certain
2121 persons who are unlawfully present in the United States and are
2222 taken into custody for committing a felony."
