44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the small-sized district adjustment under the
77 Foundation School Program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 42.103(b) and (d), Education Code, are
1010 amended to read as follows:
1111 (b) The basic allotment of a school district that [contains
1212 at least 300 square miles and] has not more than 1,600 students in
1313 average daily attendance is adjusted by applying the formula:
1414 AA = (1 + ((1,600 - ADA) X .0004)) X ABA
1515 (d) The basic allotment of a school district that offers a
1616 kindergarten through grade 12 program and has less than 5,000
1717 students in average daily attendance is adjusted by applying the
1818 formula, of the following formulas, that results in the greatest
1919 adjusted allotment:
2020 (1) the formula in Subsection (b), if [or (c) for
2121 which] the district is eligible for that formula; or
2222 (2) AA = (1 + ((5,000 - ADA) X .000025)) X ABA.
2323 SECTION 2. Section 42.103(c), Education Code, is repealed.
2424 SECTION 3. This Act takes effect January 1, 2018.
