8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Sections 42.103(b) and (d), Education Code, are | |
10 | 10 | amended to read as follows: | |
11 | 11 | (b) The basic allotment of a school district that [contains | |
12 | 12 | at least 300 square miles and] has not more than 1,600 students in | |
13 | 13 | average daily attendance is adjusted by applying the formula: | |
14 | 14 | AA = (1 + ((1,600 - ADA) X .0004)) X ABA | |
15 | 15 | (d) The basic allotment of a school district that offers a | |
16 | 16 | kindergarten through grade 12 program and has less than 5,000 | |
17 | 17 | students in average daily attendance is adjusted by applying the | |
18 | 18 | formula, of the following formulas, that results in the greatest | |
19 | 19 | adjusted allotment: | |
20 | 20 | (1) the formula in Subsection (b), if [or (c) for | |
21 | 21 | which] the district is eligible for that formula; or | |
22 | 22 | (2) AA = (1 + ((5,000 - ADA) X .000025)) X ABA. | |
23 | 23 | SECTION 2. Section 42.103(c), Education Code, is repealed. | |
24 | 24 | SECTION 3. This Act takes effect January 1, 2018. |
