66 relating to the disposal of pesticides.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 76, Agriculture Code, is
99 amended by adding Section 76.009 to read as follows:
1010 Sec. 76.009. PESTICIDE DISPOSAL FUND. (a) The pesticide
1111 disposal fund is a fund in the state treasury outside the general
1212 revenue fund. The fund consists of:
1313 (1) money deposited to the credit of the fund under
1414 Section 76.044; and
1515 (2) interest earned on the investment of money in the
1616 fund.
1717 (b) The department shall administer the fund. Money in the
1818 fund may be appropriated only for the purposes of the pesticide
1919 waste and pesticide container collection activities performed
2020 under Section 76.132.
2121 SECTION 2. Section 76.044, Agriculture Code, is amended by
2222 adding Subsection (c) to read as follows:
2323 (c) Of the money received by the department under this
2424 section, the department shall annually deposit to the credit of the
2525 pesticide disposal fund under Section 76.009 an amount to cover the
2626 cost of administering the pesticide waste and pesticide container
2727 collection activities performed under Section 76.132, not to exceed
2828 $400,000.
2929 SECTION 3. Subchapter F, Chapter 76, Agriculture Code, is
3030 amended by adding Section 76.132 to read as follows:
3131 Sec. 76.132. DISPOSAL OF PESTICIDE. The department, in
3232 coordination with the Texas A&M AgriLife Extension Service, shall
3333 organize pesticide waste and pesticide container collection
3434 activities statewide. The department and Texas A&M AgriLife
3535 Extension Service may contract for the services of contractors that
3636 are licensed in the disposal of hazardous waste under Section
3737 401.202, Health and Safety Code, or other contractors to implement
3838 the pesticide waste and pesticide container collection activities
3939 and facilitate the collection of canceled, unregistered, or
4040 otherwise unwanted pesticide products and pesticide containers.
4141 SECTION 4. This Act takes effect September 1, 2017.
