7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Subchapter A, Chapter 76, Agriculture Code, is |
---|
9 | 9 | | amended by adding Section 76.009 to read as follows: |
---|
10 | 10 | | Sec. 76.009. PESTICIDE DISPOSAL FUND. (a) The pesticide |
---|
11 | 11 | | disposal fund is a fund in the state treasury outside the general |
---|
12 | 12 | | revenue fund. The fund consists of: |
---|
13 | 13 | | (1) money deposited to the credit of the fund under |
---|
14 | 14 | | Section 76.044; and |
---|
15 | 15 | | (2) interest earned on the investment of money in the |
---|
16 | 16 | | fund. |
---|
17 | 17 | | (b) The department shall administer the fund. Money in the |
---|
18 | 18 | | fund may be appropriated only for the purposes of the pesticide |
---|
19 | 19 | | waste and pesticide container collection activities performed |
---|
20 | 20 | | under Section 76.132. |
---|
21 | 21 | | SECTION 2. Section 76.044, Agriculture Code, is amended by |
---|
22 | 22 | | adding Subsection (c) to read as follows: |
---|
23 | 23 | | (c) Of the money received by the department under this |
---|
24 | 24 | | section, the department shall annually deposit to the credit of the |
---|
25 | 25 | | pesticide disposal fund under Section 76.009 an amount to cover the |
---|
26 | 26 | | cost of administering the pesticide waste and pesticide container |
---|
27 | 27 | | collection activities performed under Section 76.132, not to exceed |
---|
28 | 28 | | $400,000. |
---|
29 | 29 | | SECTION 3. Subchapter F, Chapter 76, Agriculture Code, is |
---|
30 | 30 | | amended by adding Section 76.132 to read as follows: |
---|
31 | 31 | | Sec. 76.132. DISPOSAL OF PESTICIDE. The department, in |
---|
32 | 32 | | coordination with the Texas A&M AgriLife Extension Service, shall |
---|
33 | 33 | | organize pesticide waste and pesticide container collection |
---|
34 | 34 | | activities statewide. The department and Texas A&M AgriLife |
---|
35 | 35 | | Extension Service may contract for the services of contractors that |
---|
36 | 36 | | are licensed in the disposal of hazardous waste under Section |
---|
37 | 37 | | 401.202, Health and Safety Code, or other contractors to implement |
---|
38 | 38 | | the pesticide waste and pesticide container collection activities |
---|
39 | 39 | | and facilitate the collection of canceled, unregistered, or |
---|
40 | 40 | | otherwise unwanted pesticide products and pesticide containers. |
---|
41 | 41 | | SECTION 4. This Act takes effect September 1, 2017. |
