66 AN ACT
77 relating to the licensing and regulation of a journeyman lineman.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1305.002(12), Occupations Code, is
1010 amended to read as follows:
1111 (12) "Journeyman lineman" means an individual who
1212 engages in electrical work involving the installation,
1313 maintenance, and operation of equipment associated with the
1414 transmission and distribution of electricity from the
1515 electricity's original source to a substation and from a substation
1616 to the point where the electricity enters a building or structure on
1717 a customer's premises for further distribution.
1818 SECTION 2. Section 1305.101(a), Occupations Code, is
1919 amended to read as follows:
2020 (a) The executive director or commission, as appropriate,
2121 shall:
2222 (1) by rule establish the financial responsibility
2323 requirements for electrical contractors; [and]
2424 (2) after publication of the National Electrical Code
2525 by the National Fire Protection Association every three years,
2626 adopt the revised National Electrical Code as the electrical code
2727 for the state; and
2828 (3) after publication of the National Electrical
2929 Safety Code by the Institute of Electrical and Electronics
3030 Engineers every five years, adopt the revised National Electrical
3131 Safety Code for purposes of Section 1305.162(f).
3232 SECTION 3. Section 1305.162, Occupations Code, is amended
3333 by adding Subsection (f) to read as follows:
3434 (f) In addition to the other requirements of this section,
3535 the department shall accept, develop, or contract for a journeyman
3636 lineman examination that tests an applicant's knowledge of:
3737 (1) materials and methods used in the installation,
3838 maintenance, and operation of equipment associated with the
3939 transmission and distribution of electricity from the
4040 electricity's original source to a substation and from a substation
4141 to the point where the electricity enters a building or structure on
4242 a customer's premises for further distribution; and
4343 (2) the standards prescribed by the National
4444 Electrical Safety Code as adopted by the commission.
4545 SECTION 4. Section 1305.162(f), Occupations Code, as added
4646 by this Act, applies only to an examination for a journeyman lineman
4747 license administered on or after September 1, 2018. An examination
4848 for a journeyman lineman license administered before that date is
4949 governed by the law in effect on the date the examination was
5050 administered, and the former law is continued in effect for that
5151 purpose.
5252 SECTION 5. Not later than June 1, 2018, the Texas Commission
5353 of Licensing and Regulation shall adopt rules necessary to
5454 implement Sections 1305.101(a)(3) and 1305.162(f), Occupations
5555 Code, as added by this Act.
5656 SECTION 6. This Act takes effect December 1, 2017.
