|---|
| 7 | 7 | | relating to the licensing and regulation of a journeyman lineman. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1305.002(12), Occupations Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (12) "Journeyman lineman" means an individual who |
|---|
| 12 | 12 | | engages in electrical work involving the installation, |
|---|
| 13 | 13 | | maintenance, and operation of equipment associated with the |
|---|
| 14 | 14 | | transmission and distribution of electricity from the |
|---|
| 15 | 15 | | electricity's original source to a substation and from a substation |
|---|
| 16 | 16 | | to the point where the electricity enters a building or structure on |
|---|
| 17 | 17 | | a customer's premises for further distribution. |
|---|
| 18 | 18 | | SECTION 2. Section 1305.101(a), Occupations Code, is |
|---|
| 19 | 19 | | amended to read as follows: |
|---|
| 20 | 20 | | (a) The executive director or commission, as appropriate, |
|---|
| 21 | 21 | | shall: |
|---|
| 22 | 22 | | (1) by rule establish the financial responsibility |
|---|
| 23 | 23 | | requirements for electrical contractors; [and] |
|---|
| 24 | 24 | | (2) after publication of the National Electrical Code |
|---|
| 25 | 25 | | by the National Fire Protection Association every three years, |
|---|
| 26 | 26 | | adopt the revised National Electrical Code as the electrical code |
|---|
| 27 | 27 | | for the state; and |
|---|
| 28 | 28 | | (3) after publication of the National Electrical |
|---|
| 29 | 29 | | Safety Code by the Institute of Electrical and Electronics |
|---|
| 30 | 30 | | Engineers every five years, adopt the revised National Electrical |
|---|
| 31 | 31 | | Safety Code for purposes of Section 1305.162(f). |
|---|
| 32 | 32 | | SECTION 3. Section 1305.162, Occupations Code, is amended |
|---|
| 33 | 33 | | by adding Subsection (f) to read as follows: |
|---|
| 34 | 34 | | (f) In addition to the other requirements of this section, |
|---|
| 35 | 35 | | the department shall accept, develop, or contract for a journeyman |
|---|
| 36 | 36 | | lineman examination that tests an applicant's knowledge of: |
|---|
| 37 | 37 | | (1) materials and methods used in the installation, |
|---|
| 38 | 38 | | maintenance, and operation of equipment associated with the |
|---|
| 39 | 39 | | transmission and distribution of electricity from the |
|---|
| 40 | 40 | | electricity's original source to a substation and from a substation |
|---|
| 41 | 41 | | to the point where the electricity enters a building or structure on |
|---|
| 42 | 42 | | a customer's premises for further distribution; and |
|---|
| 43 | 43 | | (2) the standards prescribed by the National |
|---|
| 44 | 44 | | Electrical Safety Code as adopted by the commission. |
|---|
| 45 | 45 | | SECTION 4. Section 1305.162(f), Occupations Code, as added |
|---|
| 46 | 46 | | by this Act, applies only to an examination for a journeyman lineman |
|---|
| 47 | 47 | | license administered on or after September 1, 2018. An examination |
|---|
| 48 | 48 | | for a journeyman lineman license administered before that date is |
|---|
| 49 | 49 | | governed by the law in effect on the date the examination was |
|---|
| 50 | 50 | | administered, and the former law is continued in effect for that |
|---|
| 51 | 51 | | purpose. |
|---|
| 52 | 52 | | SECTION 5. Not later than June 1, 2018, the Texas Commission |
|---|
| 53 | 53 | | of Licensing and Regulation shall adopt rules necessary to |
|---|
| 54 | 54 | | implement Sections 1305.101(a)(3) and 1305.162(f), Occupations |
|---|
| 55 | 55 | | Code, as added by this Act. |
|---|
| 56 | 56 | | SECTION 6. This Act takes effect December 1, 2017. |
