68 AN ACT
79 relating to pregnancy-related deaths and maternal morbidity,
810 including postpartum depression.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. This Act shall be known as the Texas Moms Matter
1113 Act.
12- SECTION 2. Section 34.001(12), Health and Safety Code, is
13- amended to read as follows:
14- (12) "Pregnancy-related death" means the death of a
15- woman while pregnant or within one year of delivery or end of
16- pregnancy, regardless of the duration and site of the pregnancy,
17- from any cause related to or aggravated by the pregnancy or its
18- management, including direct obstetric death or an underlying
19- aggravating condition causing obstetric death [but not from
20- accidental or incidental causes].
21- SECTION 3. Section 34.005, Health and Safety Code, is

2821 maternal morbidity;
2922 (C) the most prevalent health conditions and
3023 factors that caused death in African American women as identified
3124 in the task force's biennial report required under Section 34.015;

3326 (D) best practices and programs operating in
3427 other states that have reduced rates of pregnancy-related deaths;
3528 (2) compare rates of pregnancy-related deaths based on
36- the socioeconomic status of the mother and, contingent on available
37- resources, compare rates of infant mortality based on that status;
29+ the socioeconomic status of the mother;
3830 (3) determine the feasibility of the task force
3931 studying cases of severe maternal morbidity; and
4032 (4) [(3)] make recommendations to help reduce the
4133 incidence of pregnancy-related deaths and severe maternal
4234 morbidity in this state.
43- SECTION 4. Sections 34.007(a) and (b), Health and Safety

4638 significant number of cases of pregnancy-related deaths for review.

5042 (b) The department shall statistically analyze aggregate
5143 data of pregnancy-related deaths and severe maternal morbidity in
5244 this state to identify any trends, rates, or disparities.

6153 (1) evaluate options for reducing pregnancy-related
6254 deaths, focusing on the most prevalent causes of pregnancy-related
6355 deaths as identified in the task force's biennial report required
6456 under Section 34.015, and for treating postpartum depression in
6557 economically disadvantaged women; and
6658 (2) submit a written report summarizing the
6759 commission's and department's efforts to accomplish the tasks
6860 described by Subdivision (1) to the governor, the lieutenant
6961 governor, the speaker of the house of representatives, the
7062 Legislative Budget Board, and the appropriate standing committees
7163 of the legislature not later than December 1 of each even-numbered
7264 year.
73- SECTION 7. Section 34.018, Health and Safety Code, is

7567 Sec. 34.018. SUNSET PROVISION. The task force is subject to
7668 Chapter 325, Government Code (Texas Sunset Act). Unless continued
7769 in existence as provided by that chapter, the task force is
7870 abolished and this chapter expires September 1, 2023 [2019].
79- SECTION 8. Section 193.001, Health and Safety Code, is
80- amended by adding Subsection (a-2) to read as follows:
81- (a-2) In prescribing the form and contents of death
82- certificates, the department shall require each death certificate
83- to indicate whether a female decedent was pregnant at the time of
84- death or was pregnant at any time in the year preceding the
85- decedent's death, if known
86- .
87- SECTION 9. (a) Not later than March 1, 2018, the Department
88- of State Health Services shall revise and make available the forms
89- required by Section 193.001, Health and Safety Code, as amended by
90- this Act.
91- (b) Section 193.001, Health and Safety Code, as amended by
92- this Act applies only to a death certificate filed on or after April
93- 1, 2018.
94- SECTION 10. This Act takes effect immediately if it
95- receives a vote of two-thirds of all the members elected to each
96- house, as provided by Section 39, Article III, Texas Constitution.
97- If this Act does not receive the vote necessary for immediate
98- effect, this Act takes effect on the 91st day after the last day of
99- the legislative session.
71+ SECTION 7. This Act takes effect immediately if it receives
72+ a vote of two-thirds of all the members elected to each house, as
73+ provided by Section 39, Article III, Texas Constitution. If this
74+ Act does not receive the vote necessary for immediate effect, this
75+ Act takes effect on the 91st day after the last day of the
76+ legislative session.
