55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a defense to prosecution for the offense of trespass by
88 certain persons carrying handguns.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 30.06, Penal Code, is amended by adding
1111 Subsection (g) to read as follows:
1212 (g) It is a defense to prosecution under this section that
1313 the license holder was personally given notice by oral
1414 communication described by Subsection (b) and promptly departed
1515 from the property.
1616 SECTION 2. Section 30.07, Penal Code, is amended by adding
1717 Subsection (h) to read as follows:
1818 (h) It is a defense to prosecution under this section that
1919 the license holder was personally given notice by oral
2020 communication described by Subsection (b) and promptly departed
2121 from the property.
2222 SECTION 3. The change in law made by this Act applies only
2323 to an offense committed on or after the effective date of this Act.
2424 An offense committed before the effective date of this Act is
2525 governed by the law in effect on the date the offense was committed,
2626 and the former law is continued in effect for that purpose. For
2727 purposes of this section, an offense was committed before the
2828 effective date of this Act if any element of the offense occurred
2929 before that date.
3030 SECTION 4. This Act takes effect December 1, 2017.
