55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibiting the use of appropriated state funds for
88 abortion services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2113.001, Government Code, is amended to
1111 read as follows:
1212 Sec. 2113.001. DEFINITIONS. Except as otherwise provided
1313 by this chapter, in this chapter:
1414 (1) "Appropriated money" means money appropriated by
1515 the legislature through the General Appropriations Act or other
1616 law.
1717 (2) "State agency" means:
1818 (A) a department, commission, board, office, or
1919 other entity in the executive branch of state government;
2020 (B) the supreme court, the court of criminal
2121 appeals, another entity in the judicial branch of state government
2222 with statewide authority, or a court of appeals; or
2323 (C) a university system or an institution of
2424 higher education as defined by Section 61.003, Education Code,
2525 except that a public junior college is excluded from the meaning of
2626 the term in all of Subchapter C except Sections [Section] 2113.101
2727 and 2113.108 and all of Subchapter D except Section 2113.205.
2828 SECTION 2. Subchapter C, Chapter 2113, Government Code, is
2929 amended by adding Section 2113.108 to read as follows:
3030 Sec. 2113.108. ABORTION SERVICES. A state agency or a
3131 political subdivision may not use appropriated money to pay or
3232 reimburse, directly or through a contract or grant, a person that
3333 pays for or provides abortion services.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect December 1, 2017.
