| 7 | 7 | | relating to the election of trustees of certain school districts. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 11.052, Education Code, is amended by |
|---|
| 10 | 10 | | adding Subsection (b-1) and amending Subsection (d) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (b-1) Subsection (c) does not apply in the case of an order |
|---|
| 13 | 13 | | adopted under this subsection. The board of trustees of an |
|---|
| 14 | 14 | | independent school district with the largest student enrollment in |
|---|
| 15 | 15 | | a county with a population of 555,000 or more that is adjacent to a |
|---|
| 16 | 16 | | county with a population of 3.3 million or more shall order that |
|---|
| 17 | 17 | | trustees of the district are to be elected in the following manner: |
|---|
| 18 | 18 | | (1) one trustee must be elected from the district at |
|---|
| 19 | 19 | | large; and |
|---|
| 20 | 20 | | (2) the remaining trustees must be elected from |
|---|
| 21 | 21 | | single-member districts, with all single-member trustee districts |
|---|
| 22 | 22 | | grouped into two multimember voting districts in which, |
|---|
| 23 | 23 | | notwithstanding Subsection (g), residents of each multimember |
|---|
| 24 | 24 | | voting district are entitled to cast votes for each trustee |
|---|
| 25 | 25 | | district within the multimember voting district. |
|---|
| 26 | 26 | | (d) An order of the board adopted under Subsection (a), [or] |
|---|
| 27 | 27 | | (b), or (b-1) must be entered not later than the 120th day before |
|---|
| 28 | 28 | | the date of the first election at which all or some of the trustees |
|---|
| 29 | 29 | | are elected from single-member trustee districts authorized by the |
|---|
| 30 | 30 | | order. |
|---|
| 31 | 31 | | SECTION 2. The board of trustees of a school district to |
|---|
| 32 | 32 | | which Section 11.052(b-1), Education Code, as added by this Act, |
|---|
| 33 | 33 | | applies shall adopt an order as required by that section not later |
|---|
| 34 | 34 | | than January 31, 2018. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect December 1, 2017. |
