6	6	AN ACT
7	7	relating to a reduction in required days of service for educators in
8	8	public schools under certain circumstances.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 21.401, Education Code, is amended by
11	11	amending Subsection (b) and adding Subsection (c-1) to read as
12	12	follows:
13	13	(b) Except as provided by Subsection (c-1), an [An] educator
14	14	employed under a 10-month contract must provide a minimum of 187
15	15	days of service.
16	16	(c-1) If a school district anticipates providing less than
17	17	180 days of instruction for students during a school year, as
18	18	indicated by the district's academic calendar, the district may
19	19	reduce the number of days of service required by this section
20	20	proportionately. A reduction by the district does not reduce an
21	21	educator's salary.
22	22	SECTION 2. Section 21.401, Education Code, as amended by
23	23	this Act, applies only to a contract executed on or after the
24	24	effective date of this Act. A contract executed before the
25	25	effective date of this Act is governed by the law in effect on the
26	26	date the contract was executed, and the former law is continued in
27	27	effect for that purpose.
28	28	SECTION 3. This Act takes effect immediately if it receives
29	29	a vote of two-thirds of all the members elected to each house, as
30	30	provided by Section 39, Article III, Texas Constitution. If this
31	31	Act does not receive the vote necessary for immediate effect, this
32	32	Act takes effect on the 91st day after the last day of the
33	33	legislative session.
