55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a reduction in required days of service for educators in
88 public schools under certain circumstances.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.401, Education Code, is amended by
1111 amending Subsection (b) and adding Subsection (c-1) to read as
1212 follows:
1313 (b) Except as provided by Subsection (c-1), an [An] educator
1414 employed under a 10-month contract must provide a minimum of 187
1515 days of service.
1616 (c-1) If a school district anticipates providing less than
1717 180 days of instruction for students during a school year, as
1818 indicated by the district's academic calendar, the district may
1919 reduce the number of days of service required by this section
2020 proportionately. A reduction by the district does not reduce an
2121 educator's salary.
2222 SECTION 2. Section 21.401, Education Code, as amended by
2323 this Act, applies only to a contract executed on or after the
2424 effective date of this Act. A contract executed before the
2525 effective date of this Act is governed by the law in effect on the
2626 date the contract was executed, and the former law is continued in
2727 effect for that purpose.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect on the 91st day after the last day of the
3333 legislative session.
