7 | 7 | | relating to the authority of a county to end a low-income vehicle |

8 | 8 | | repair assistance, retrofit, and accelerated vehicle retirement |
---|
9 | 9 | | program in the county. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. Section 382.209, Health and Safety Code, is |
---|
12 | 12 | | amended by adding Subsections (k), (l), (m), and (n) to read as |
---|
13 | 13 | | follows: |
---|
14 | 14 | | (k) The commissioners court of a participating county may |
---|
15 | 15 | | adopt a resolution to end the low-income vehicle repair assistance, |
---|
16 | 16 | | retrofit, and accelerated vehicle retirement program in the county. |
---|
17 | 17 | | The commissioners court shall submit the resolution to the |
---|
18 | 18 | | commission and to the county tax assessor-collector. The |
---|
19 | 19 | | resolution must include a date after which a fee may not be imposed |
---|
20 | 20 | | under Section 382.202 or 382.302 for the purposes of the county's |
---|
21 | 21 | | low-income vehicle repair assistance, retrofit, and accelerated |
---|
22 | 22 | | vehicle retirement program on vehicles being inspected or |
---|
23 | 23 | | registered in the county. The date must be: |
---|
24 | 24 | | (1) the first day of a month; and |
---|
25 | 25 | | (2) at least 30 days after the date the resolution is |
---|
26 | 26 | | submitted to the commission. |
---|
27 | 27 | | (l) On receipt of a resolution under Subsection (k), the |
---|
28 | 28 | | commission shall notify, in writing, the Texas Department of Motor |
---|
29 | 29 | | Vehicles, the Department of Public Safety, and the Legislative |
---|
30 | 30 | | Budget Board that a fee may not be imposed under Section 382.202 or |
---|
31 | 31 | | 382.302 for the purposes of the county's low-income vehicle repair |
---|
32 | 32 | | assistance, retrofit, and accelerated vehicle retirement program |
---|
33 | 33 | | on vehicles being inspected or registered in the county after the |
---|
34 | 34 | | date established under Subsection (k). |
---|
35 | 35 | | (m) In the first fiscal biennium that begins after a county |
---|
36 | 36 | | adopts a resolution under Subsection (k), the legislature shall |
---|
37 | 37 | | appropriate to the commission, for the sole purpose of returning |
---|
38 | 38 | | the money to the county, any remaining money collected in the county |
---|
39 | 39 | | from a fee authorized under Section 382.202 or 382.302 for the |
---|
40 | 40 | | purposes of the county's low-income vehicle repair assistance, |
---|
41 | 41 | | retrofit, and accelerated vehicle retirement program. This |
---|
42 | 42 | | subsection does not apply to money collected from a fee authorized |
---|
43 | 43 | | under Section 382.202 or 382.302 that the commission would |
---|
44 | 44 | | otherwise have used for administrative purposes. The commission |
---|
45 | 45 | | shall distribute to the county money appropriated to the commission |
---|
46 | 46 | | for the county under this subsection. |
---|
47 | 47 | | (n) A county that receives a distribution of money under |
---|
48 | 48 | | Subsection (m) may use the money for remaining expenses of the |
---|
49 | 49 | | county's low-income vehicle repair assistance, retrofit, and |
---|
50 | 50 | | accelerated vehicle retirement program or for any other purpose. |
---|
51 | 51 | | SECTION 2. This Act takes effect December 1, 2017. |
