66 AN ACT
77 relating to the authority of a county to end a low-income vehicle
88 repair assistance, retrofit, and accelerated vehicle retirement
99 program in the county.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 382.209, Health and Safety Code, is
1212 amended by adding Subsections (k), (l), (m), and (n) to read as
1313 follows:
1414 (k) The commissioners court of a participating county may
1515 adopt a resolution to end the low-income vehicle repair assistance,
1616 retrofit, and accelerated vehicle retirement program in the county.
1717 The commissioners court shall submit the resolution to the
1818 commission and to the county tax assessor-collector. The
1919 resolution must include a date after which a fee may not be imposed
2020 under Section 382.202 or 382.302 for the purposes of the county's
2121 low-income vehicle repair assistance, retrofit, and accelerated
2222 vehicle retirement program on vehicles being inspected or
2323 registered in the county. The date must be:
2424 (1) the first day of a month; and
2525 (2) at least 30 days after the date the resolution is
2626 submitted to the commission.
2727 (l) On receipt of a resolution under Subsection (k), the
2828 commission shall notify, in writing, the Texas Department of Motor
2929 Vehicles, the Department of Public Safety, and the Legislative
3030 Budget Board that a fee may not be imposed under Section 382.202 or
3131 382.302 for the purposes of the county's low-income vehicle repair
3232 assistance, retrofit, and accelerated vehicle retirement program
3333 on vehicles being inspected or registered in the county after the
3434 date established under Subsection (k).
3535 (m) In the first fiscal biennium that begins after a county
3636 adopts a resolution under Subsection (k), the legislature shall
3737 appropriate to the commission, for the sole purpose of returning
3838 the money to the county, any remaining money collected in the county
3939 from a fee authorized under Section 382.202 or 382.302 for the
4040 purposes of the county's low-income vehicle repair assistance,
4141 retrofit, and accelerated vehicle retirement program. This
4242 subsection does not apply to money collected from a fee authorized
4343 under Section 382.202 or 382.302 that the commission would
4444 otherwise have used for administrative purposes. The commission
4545 shall distribute to the county money appropriated to the commission
4646 for the county under this subsection.
4747 (n) A county that receives a distribution of money under
4848 Subsection (m) may use the money for remaining expenses of the
4949 county's low-income vehicle repair assistance, retrofit, and
5050 accelerated vehicle retirement program or for any other purpose.
5151 SECTION 2. This Act takes effect December 1, 2017.
