66 AN ACT
77 relating to a review of the motor vehicle emissions inspection and
88 maintenance program to vehicles of certain model years.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter G, Chapter 382, Health and Safety
1111 Code, is amended by adding Section 382.2031 to read as follows:
1212 Sec. 382.2031. REVIEW OF PROGRAM. (a) The commission shall
1313 identify the minimum program required by the federal Clean Air Act
1414 (42 U.S.C. Section 7401 et seq.) for the motor vehicle inspection
1515 and maintenance program. If the commission determines that
1616 implementing only the minimum program would not adversely affect
1717 air quality in this state, the commission shall develop a state
1818 implementation plan revision and necessary rules to revise the
1919 motor vehicle inspection and maintenance program to include only
2020 the minimum program.
2121 (b) The commission shall submit the state implementation
2222 plan revision and any rules to the United States Environmental
2323 Protection Agency for approval.
2424 (c) If the United States Environmental Protection Agency
2525 approves the plan, the commission shall:
2626 (1) implement the revised program; and
2727 (2) submit to the legislature a list of recommended
2828 statutory changes to facilitate implementing the minimum program,
2929 if any.
3030 (d) Notwithstanding another provision of this chapter or
3131 Chapter 548, Transportation Code, the commission and the Department
3232 of Public Safety may implement a program developed and approved
3333 under this section, and counties may participate in implementing
3434 the program.
3535 SECTION 2. This Act takes effect December 1, 2017.
