5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the salary paid to certain professional employees of
8	8	public schools; making an appropriation.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 21.402, Education Code, is amended by
11	11	adding Subsections (c-2), (c-3), and (d) and amending Subsection
12	12	(g) to read as follows:
13	13	(c-2) Notwithstanding Subsection (a), for the 2017-2018
14	14	school year, a classroom teacher, full-time librarian, full-time
15	15	school counselor certified under Subchapter B, or full-time school
16	16	nurse is entitled to a monthly salary that is at least equal to the
17	17	sum of:
18	18	(1) the monthly salary the teacher would have received
19	19	for the 2017-2018 school year under the district's salary schedule
20	20	for the 2016-2017 school year, if that schedule had been in effect
21	21	for the 2017-2018 school year, including any local supplement and
22	22	any money representing a career ladder supplement the teacher would
23	23	have received in the 2017-2018 school year; and
24	24	(2) $250.
25	25	(c-3) Subsection (c-2) and this subsection expire September
26	26	1, 2018.
27	27	(d) A classroom teacher, full-time librarian, full-time
28	28	school counselor certified under Subchapter B, or full-time school
29	29	nurse employed by a school district in the 2017-2018 school year is,
30	30	as long as the teacher is employed by the same district, entitled to
31	31	a salary that is at least equal to the salary the teacher received
32	32	for the 2017-2018 school year.
33	33	(g) The commissioner may adopt rules to govern the
34	34	application of this section, including rules that:
35	35	(1) require the payment of a minimum salary under this
36	36	section to a person employed in more than one capacity for which a
37	37	minimum salary is provided and whose combined employment in those
38	38	capacities constitutes full-time employment; and
39	39	(2) specify the credentials a person must hold to be
40	40	considered a [speech pathologist or] school nurse under this
41	41	section.
42	42	SECTION 2. Section 42.2513(a), Education Code, is amended
43	43	to read as follows:
44	44	(a) A school district, including a school district that is
45	45	otherwise ineligible for state aid under this chapter, is entitled
46	46	to state aid in an amount equal to the sum of:
47	47	(1) the product of $500 multiplied by the number of
48	48	full-time district employees, other than administrators or
49	49	employees subject to the minimum salary schedule under Section
50	50	21.402; [and]
51	51	(2) the product of $2,500 multiplied by the number of
52	52	classroom teachers, full-time librarians, full-time school
53	53	counselors certified under Subchapter B, Chapter 21, and full-time
54	54	school nurses employed by the district; and
55	55	(3) the product of $250 multiplied by the number of
56	56	part-time district employees, other than administrators.
57	57	SECTION 3. The amount of $2.5 billion is appropriated from
58	58	the economic stabilization fund to the foundation school fund for
59	59	distribution by the commissioner of education during the state
60	60	fiscal biennium beginning September 1, 2017, to school districts to
61	61	provide salary increases as provided by Section 42.2513, Education
62	62	Code, as amended by this Act.
63	63	SECTION 4. Section 21.402(c-1), Education Code, is
64	64	repealed.
65	65	SECTION 5. (a) Subject to Subsection (b) of this section:
66	66	(1) this Act takes effect immediately if it receives a
67	67	vote of two-thirds of all the members elected to each house, as
68	68	provided by Section 39, Article III, Texas Constitution; and
69	69	(2) if this Act does not receive the vote necessary for
70	70	immediate effect, this Act takes effect on the 91st day after the
71	71	last day of the legislative session.
72	72	(b) This Act takes effect only if it receives a vote of
73	73	two-thirds of the members present in each house of the legislature,
74	74	as provided by Section 49-g(m), Article III, Texas Constitution.
