55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the salary paid to certain professional employees of
88 public schools; making an appropriation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.402, Education Code, is amended by
1111 adding Subsections (c-2), (c-3), and (d) and amending Subsection
1212 (g) to read as follows:
1313 (c-2) Notwithstanding Subsection (a), for the 2017-2018
1414 school year, a classroom teacher, full-time librarian, full-time
1515 school counselor certified under Subchapter B, or full-time school
1616 nurse is entitled to a monthly salary that is at least equal to the
1717 sum of:
1818 (1) the monthly salary the teacher would have received
1919 for the 2017-2018 school year under the district's salary schedule
2020 for the 2016-2017 school year, if that schedule had been in effect
2121 for the 2017-2018 school year, including any local supplement and
2222 any money representing a career ladder supplement the teacher would
2323 have received in the 2017-2018 school year; and
2424 (2) $250.
2525 (c-3) Subsection (c-2) and this subsection expire September
2626 1, 2018.
2727 (d) A classroom teacher, full-time librarian, full-time
2828 school counselor certified under Subchapter B, or full-time school
2929 nurse employed by a school district in the 2017-2018 school year is,
3030 as long as the teacher is employed by the same district, entitled to
3131 a salary that is at least equal to the salary the teacher received
3232 for the 2017-2018 school year.
3333 (g) The commissioner may adopt rules to govern the
3434 application of this section, including rules that:
3535 (1) require the payment of a minimum salary under this
3636 section to a person employed in more than one capacity for which a
3737 minimum salary is provided and whose combined employment in those
3838 capacities constitutes full-time employment; and
3939 (2) specify the credentials a person must hold to be
4040 considered a [speech pathologist or] school nurse under this
4141 section.
4242 SECTION 2. Section 42.2513(a), Education Code, is amended
4343 to read as follows:
4444 (a) A school district, including a school district that is
4545 otherwise ineligible for state aid under this chapter, is entitled
4646 to state aid in an amount equal to the sum of:
4747 (1) the product of $500 multiplied by the number of
4848 full-time district employees, other than administrators or
4949 employees subject to the minimum salary schedule under Section
5050 21.402; [and]
5151 (2) the product of $2,500 multiplied by the number of
5252 classroom teachers, full-time librarians, full-time school
5353 counselors certified under Subchapter B, Chapter 21, and full-time
5454 school nurses employed by the district; and
5555 (3) the product of $250 multiplied by the number of
5656 part-time district employees, other than administrators.
5757 SECTION 3. The amount of $2.5 billion is appropriated from
5858 the economic stabilization fund to the foundation school fund for
5959 distribution by the commissioner of education during the state
6060 fiscal biennium beginning September 1, 2017, to school districts to
6161 provide salary increases as provided by Section 42.2513, Education
6262 Code, as amended by this Act.
6363 SECTION 4. Section 21.402(c-1), Education Code, is
6464 repealed.
6565 SECTION 5. (a) Subject to Subsection (b) of this section:
6666 (1) this Act takes effect immediately if it receives a
6767 vote of two-thirds of all the members elected to each house, as
6868 provided by Section 39, Article III, Texas Constitution; and
6969 (2) if this Act does not receive the vote necessary for
7070 immediate effect, this Act takes effect on the 91st day after the
7171 last day of the legislative session.
7272 (b) This Act takes effect only if it receives a vote of
7373 two-thirds of the members present in each house of the legislature,
7474 as provided by Section 49-g(m), Article III, Texas Constitution.
