55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a limitation on the amount of school property tax
88 revenue that is subject to recapture under the public school
99 finance system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 41, Education Code, is
1212 amended by adding Section 41.0932 to read as follows:
1313 Sec. 41.0932. LIMITATION ON TOTAL COST. (a)
1414 Notwithstanding any other provision of this chapter, a school
1515 district that executes an agreement to purchase all attendance
1616 credits necessary to reduce the district's wealth per student to
1717 the equalized wealth level:
1818 (1) is entitled to retain maintenance and operations
1919 tax revenue sufficient to pay the district's average maintenance
2020 and operations costs per student in average daily attendance, as
2121 determined under Subsection (b) and adjusted for inflation; and
2222 (2) may not be required to pay a total amount for
2323 attendance credits that would reduce the district's retained
2424 maintenance and operations tax revenue below the amount described
2525 by Subdivision (1).
2626 (b) For purposes of Subsection (a)(1), the commissioner
2727 shall determine a school district's average maintenance and
2828 operations costs per student in average daily attendance based on
2929 the district's maintenance and operations expenditures per student
3030 in average daily attendance for the preceding three school years.
3131 The commissioner shall adjust a district's average costs to reflect
3232 inflation in a manner determined appropriate by the commissioner.
3333 (c) A determination by the commissioner under this section
3434 is final and may not be appealed.
3535 (d) The commissioner shall adopt rules necessary to
3636 implement this section.
3737 SECTION 2. This Act takes effect September 1, 2017, if it
3838 receives a vote of two-thirds of all the members elected to each
3939 house, as provided by Section 39, Article III, Texas Constitution.
4040 If this Act does not receive the vote necessary for effect on that
4141 date, this Act takes effect on the 91st day after the last day of the
4242 legislative session.
