66 AN ACT
77 relating to the provision of information to certain women enrolled
88 in the Texas women's health program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0997 to read as follows:
1212 Sec. 531.0997. INFORMATION FOR CERTAIN ENROLLEES IN THE
1313 TEXAS WOMEN'S HEALTH PROGRAM. (a) In this section, "Texas women's
1414 health program" means a program operated by the commission that is
1515 substantially similar to the demonstration project operated under
1616 former Section 32.0248, Human Resources Code, and that is intended
1717 to expand access to preventive health and family planning services
1818 for women in this state.
1919 (b) This section applies to a woman who is automatically
2020 enrolled in the Texas women's health program following a pregnancy
2121 for which the woman received Medicaid, but who is no longer eligible
2222 to participate in Medicaid.
2323 (c) At the time a woman described by Subsection (b) is
2424 enrolled in the Texas women's health program, the commission shall
2525 provide to the woman information about:
2626 (1) the Texas women's health program, including the
2727 services provided under the program; and
2828 (2) health risks and complications that may occur
2929 before the first anniversary of the date the woman gave birth or the
3030 pregnancy ended.
3131 (d) The Maternal Mortality and Morbidity Task Force
3232 established under Chapter 34, Health and Safety Code, or the
3333 commission, as appropriate, shall develop or approve the
3434 information provided to a woman under Subsection (c).
3535 SECTION 2. As soon as practicable after the effective date
3636 of this Act, the executive commissioner of the Health and Human
3737 Services Commission shall adopt any rules necessary to implement
3838 Section 531.0997, Government Code, as added by this Act.
3939 SECTION 3. Not later than March 31, 2018, the Maternal
4040 Mortality and Morbidity Task Force or the Health and Human Services
4141 Commission shall develop or approve the information required by
4242 Section 531.0997, Government Code, as added by this Act.
4343 SECTION 4. Section 531.0997, Government Code, as added by
4444 this Act, applies to a woman automatically enrolled in the Texas
4545 women's health program on or after May 1, 2018.
4646 SECTION 5. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect December 1, 2017.
