| 7 | 7 | | relating to the provision of information to certain women enrolled |

| 8 | 8 | | in the Texas women's health program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 531.0997 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.0997. INFORMATION FOR CERTAIN ENROLLEES IN THE |
|---|
| 13 | 13 | | TEXAS WOMEN'S HEALTH PROGRAM. (a) In this section, "Texas women's |
|---|
| 14 | 14 | | health program" means a program operated by the commission that is |
|---|
| 15 | 15 | | substantially similar to the demonstration project operated under |
|---|
| 16 | 16 | | former Section 32.0248, Human Resources Code, and that is intended |
|---|
| 17 | 17 | | to expand access to preventive health and family planning services |
|---|
| 18 | 18 | | for women in this state. |
|---|
| 19 | 19 | | (b) This section applies to a woman who is automatically |
|---|
| 20 | 20 | | enrolled in the Texas women's health program following a pregnancy |
|---|
| 21 | 21 | | for which the woman received Medicaid, but who is no longer eligible |
|---|
| 22 | 22 | | to participate in Medicaid. |
|---|
| 23 | 23 | | (c) At the time a woman described by Subsection (b) is |
|---|
| 24 | 24 | | enrolled in the Texas women's health program, the commission shall |
|---|
| 25 | 25 | | provide to the woman information about: |
|---|
| 26 | 26 | | (1) the Texas women's health program, including the |
|---|
| 27 | 27 | | services provided under the program; and |
|---|
| 28 | 28 | | (2) health risks and complications that may occur |
|---|
| 29 | 29 | | before the first anniversary of the date the woman gave birth or the |
|---|
| 30 | 30 | | pregnancy ended. |
|---|
| 31 | 31 | | (d) The Maternal Mortality and Morbidity Task Force |
|---|
| 32 | 32 | | established under Chapter 34, Health and Safety Code, or the |
|---|
| 33 | 33 | | commission, as appropriate, shall develop or approve the |
|---|
| 34 | 34 | | information provided to a woman under Subsection (c). |
|---|
| 35 | 35 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 36 | 36 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 37 | 37 | | Services Commission shall adopt any rules necessary to implement |
|---|
| 38 | 38 | | Section 531.0997, Government Code, as added by this Act. |
|---|
| 39 | 39 | | SECTION 3. Not later than March 31, 2018, the Maternal |
|---|
| 40 | 40 | | Mortality and Morbidity Task Force or the Health and Human Services |
|---|
| 41 | 41 | | Commission shall develop or approve the information required by |
|---|
| 42 | 42 | | Section 531.0997, Government Code, as added by this Act. |
|---|
| 43 | 43 | | SECTION 4. Section 531.0997, Government Code, as added by |
|---|
| 44 | 44 | | this Act, applies to a woman automatically enrolled in the Texas |
|---|
| 45 | 45 | | women's health program on or after May 1, 2018. |
|---|
| 46 | 46 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 50 | 50 | | Act takes effect December 1, 2017. |
