| 7 | 7 | | relating to additional state aid for certain school districts. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter E, Chapter 42, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 42.25162 to read as follows: |
|---|
| 11 | 11 | | Sec. 42.25162. ADDITIONAL STATE AID FOR CERTAIN DISTRICTS. |
|---|
| 12 | 12 | | (a) This section applies only to a school district that: |
|---|
| 13 | 13 | | (1) received for the 2016-2017 school year additional |
|---|
| 14 | 14 | | state aid under Section 42.2516; and |
|---|
| 15 | 15 | | (2) operated a campus during the preceding school year |
|---|
| 16 | 16 | | in a county in which no other school district operated a campus |
|---|
| 17 | 17 | | during that school year. |
|---|
| 18 | 18 | | (b) A school district to which this section applies is |
|---|
| 19 | 19 | | entitled to the additional state aid that would have been provided |
|---|
| 20 | 20 | | to the district for the current school year under Section 42.2516, |
|---|
| 21 | 21 | | as that section existed on January 1, 2017, using the percentage |
|---|
| 22 | 22 | | reduction for purposes of former Section 42.2516(i) specified by |
|---|
| 23 | 23 | | appropriation for the 2016-2017 school year. |
|---|
| 24 | 24 | | (c) A school district that is required to take action under |
|---|
| 25 | 25 | | Chapter 41 to reduce its wealth per student to the equalized wealth |
|---|
| 26 | 26 | | level and that is entitled to additional state aid under this |
|---|
| 27 | 27 | | section may receive that aid through an adjustment against the |
|---|
| 28 | 28 | | total amount of attendance credits required to be purchased under |
|---|
| 29 | 29 | | Subchapter D, Chapter 41, or the total number of nonresident |
|---|
| 30 | 30 | | students required to be educated under Subchapter E, Chapter 41, as |
|---|
| 31 | 31 | | determined by the commissioner. |
|---|
| 32 | 32 | | (d) The commissioner may adopt rules as necessary to |
|---|
| 33 | 33 | | implement this section. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2017, if it |
|---|
| 35 | 35 | | receives a vote of two-thirds of all the members elected to each |
|---|
| 36 | 36 | | house, as provided by Section 39, Article III, Texas Constitution. |
|---|
| 37 | 37 | | If this Act does not receive the vote necessary for effect on that |
|---|
| 38 | 38 | | date, this Act takes effect on the 91st day after the last day of the |
|---|
| 39 | 39 | | legislative session. |
