| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 32.02491 to read as follows: |
|---|
| 12 | 12 | | Sec. 32.02491. AUTOMATIC ENROLLMENT OF CERTAIN WOMEN IN |
|---|
| 13 | 13 | | TEXAS WOMEN'S HEALTH PROGRAM. (a) In this section, "Texas women's |
|---|
| 14 | 14 | | health program" means a program operated by the commission that is |
|---|
| 15 | 15 | | substantially similar to the demonstration project operated by the |
|---|
| 16 | 16 | | Department of State Health Services under former Section 32.0248 |
|---|
| 17 | 17 | | and that is intended to expand access to preventive health and |
|---|
| 18 | 18 | | family planning services for women in this state. |
|---|
| 19 | 19 | | (b) Subject to the eligibility requirements of the Texas |
|---|
| 20 | 20 | | women's health program, the commission shall automatically enroll a |
|---|
| 21 | 21 | | woman in the program following a pregnancy for which the woman |
|---|
| 22 | 22 | | received benefits through the medical assistance program if she is |
|---|
| 23 | 23 | | no longer eligible to participate in the medical assistance |
|---|
| 24 | 24 | | program. The commission shall implement the automatic enrollment |
|---|
| 25 | 25 | | in a manner that: |
|---|
| 26 | 26 | | (1) ensures a seamless transition in the provision of |
|---|
| 27 | 27 | | services between the medical assistance program and the Texas |
|---|
| 28 | 28 | | women's health program; and |
|---|
| 29 | 29 | | (2) allows a woman to begin receiving services through |
|---|
| 30 | 30 | | the Texas women's health program on the first day the woman is no |
|---|
| 31 | 31 | | longer eligible for the medical assistance program. |
|---|
| 32 | 32 | | (c) The executive commissioner shall adopt rules necessary |
|---|
| 33 | 33 | | to implement this section. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect December 1, 2017. |
