77 relating to the automatic enrollment of certain women in the Texas
88 women's health program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.02491 to read as follows:
1212 Sec. 32.02491. AUTOMATIC ENROLLMENT OF CERTAIN WOMEN IN
1313 TEXAS WOMEN'S HEALTH PROGRAM. (a) In this section, "Texas women's
1414 health program" means a program operated by the commission that is
1515 substantially similar to the demonstration project operated by the
1616 Department of State Health Services under former Section 32.0248
1717 and that is intended to expand access to preventive health and
1818 family planning services for women in this state.
1919 (b) Subject to the eligibility requirements of the Texas
2020 women's health program, the commission shall automatically enroll a
2121 woman in the program following a pregnancy for which the woman
2222 received benefits through the medical assistance program if she is
2323 no longer eligible to participate in the medical assistance
2424 program. The commission shall implement the automatic enrollment
2525 in a manner that:
2626 (1) ensures a seamless transition in the provision of
2727 services between the medical assistance program and the Texas
2828 women's health program; and
2929 (2) allows a woman to begin receiving services through
3030 the Texas women's health program on the first day the woman is no
3131 longer eligible for the medical assistance program.
3232 (c) The executive commissioner shall adopt rules necessary
3333 to implement this section.
3434 SECTION 2. This Act takes effect December 1, 2017.
