6	6	AN ACT
7	7	relating to the salary paid to certain professional staff employed
8	8	by public schools.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 21.402, Education Code, is amended by
11	11	adding Subsections (c-2), (c-3), and (d) and amending Subsection
12	12	(g) to read as follows:
13	13	(c-2) Notwithstanding Subsection (a), for the 2017-2018
14	14	school year, a classroom teacher, full-time librarian, full-time
15	15	school counselor certified under Subchapter B, or full-time nurse
16	16	is entitled to a monthly salary that is at least equal to the sum of:
17	17	(1) the monthly salary the employee would have
18	18	received for the 2017-2018 school year under the district's salary
19	19	schedule for the 2016-2017 school year, if that schedule had been in
20	20	effect for the 2017-2018 school year, including any local
21	21	supplement and any money representing a career ladder supplement
22	22	the employee would have received in the 2017-2018 school year; and
23	23	(2) $400.
24	24	(c-3) Subsection (c-2) and this subsection expire September
25	25	1, 2018.
26	26	(d) A classroom teacher, full-time librarian, full-time
27	27	school counselor certified under Subchapter B, or full-time nurse
28	28	employed by a school district in the 2017-2018 school year is, as
29	29	long as the employee is employed by the same district, entitled to a
30	30	salary that is at least equal to the salary the employee received
31	31	for the 2017-2018 school year.
32	32	(g) The commissioner may adopt rules to govern the
33	33	application of this section, including rules that:
34	34	(1) require the payment of a minimum salary under this
35	35	section to a person employed in more than one capacity for which a
36	36	minimum salary is provided and whose combined employment in those
37	37	capacities constitutes full-time employment; and
38	38	(2) specify the credentials a person must hold to be
39	39	considered a [speech pathologist or] school nurse under this
40	40	section.
41	41	SECTION 2. Section 42.2513(a), Education Code, is amended
42	42	to read as follows:
43	43	(a) A school district, including a school district that is
44	44	otherwise ineligible for state aid under this chapter, is entitled
45	45	to state aid in an amount equal to the sum of:
46	46	(1) the product of $500 multiplied by the number of
47	47	full-time district employees, other than administrators or
48	48	employees subject to the minimum salary schedule under Section
49	49	21.402; [and]
50	50	(2) the product of $4,000 multiplied by the number of
51	51	classroom teachers, full-time librarians, full-time school
52	52	counselors certified under Subchapter B, Chapter 21, and full-time
53	53	nurses employed by the district; and
54	54	(3) the product of $250 multiplied by the number of
55	55	part-time district employees, other than administrators.
56	56	SECTION 3. Section 21.402(c-1), Education Code, is
57	57	repealed.
58	58	SECTION 4. This Act applies beginning with the 2017-2018
59	59	school year.
60	60	SECTION 5. This Act takes effect September 1, 2017, if this
61	61	Act receives a vote of two-thirds of all the members elected to each
62	62	house, as provided by Section 39, Article III, Texas Constitution.
63	63	If this Act does not receive the vote necessary to take effect
64	64	September 1, 2017, this Act takes effect on the 91st day after the
65	65	last day of the legislative session.
