| 7 | 7 | | relating to the Legislative Budget Board's report on equalized |

| 8 | 8 | | funding elements under the public school finance system. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 42.007(a) and (b), Education Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) The Legislative Budget Board shall adopt rules, subject |
|---|
| 13 | 13 | | to appropriate notice and opportunity for public comment, for the |
|---|
| 14 | 14 | | calculation for each year of a biennium of the qualified funding |
|---|
| 15 | 15 | | elements, in accordance with Subsection (c), necessary to: |
|---|
| 16 | 16 | | (1) achieve the state policy under Section 42.001; and |
|---|
| 17 | 17 | | (2) enable each student to achieve satisfactory |
|---|
| 18 | 18 | | performance on each assessment instrument required under Section |
|---|
| 19 | 19 | | 39.023. |
|---|
| 20 | 20 | | (b) Before each regular session of the legislature, the |
|---|
| 21 | 21 | | board shall submit [, as determined by the board, report the |
|---|
| 22 | 22 | | equalized funding elements] to the commissioner and the legislature |
|---|
| 23 | 23 | | a report on the board's recommendations regarding the equalized |
|---|
| 24 | 24 | | funding elements necessary to achieve the goals described by |
|---|
| 25 | 25 | | Subsection (a) for each year of the next state fiscal biennium. |

| 26 | 26 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 27 | 27 | | of this Act, the Legislative Budget Board shall adopt the rules |
|---|
| 28 | 28 | | required under Section 42.007(a), Education Code, as amended by |
|---|
| 29 | 29 | | this Act. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect on the 91st day after the last day of the |
|---|
| 35 | 35 | | legislative session. |
