55 AN ACT
66 relating to prohibited adverse personnel action against a school
77 district employee who in good faith reports child abuse or neglect.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 261.110, Family Code, is amended by
1010 amending Subsections (a) and (c) and adding Subsections (b-1) and
1111 (c-1) to read as follows:
1212 (a) In this section:
1313 (1) "Adverse personnel action" means an action that
1414 affects an employee's compensation, promotion, transfer, work
1515 assignment, or performance evaluation, or any other action that
1616 would dissuade a reasonable employee from making or supporting a
1717 report of abuse or neglect under Section 261.101.
1818 (2) "Professional"[, "professional"] has the meaning
1919 assigned by Section 261.101(b).
2020 (b-1) A school district may not suspend or terminate the
2121 employment of, discriminate against, or take any other adverse
2222 personnel action against a district employee who in good faith:
2323 (1) reports child abuse or neglect to:
2424 (A) the employee's supervisor;
2525 (B) an administrator of the facility where the
2626 employee is employed;
2727 (C) a state regulatory agency; or
2828 (D) a law enforcement agency; or
2929 (2) initiates or cooperates with an investigation or
3030 proceeding by a governmental entity relating to an allegation of
3131 child abuse or neglect.
3232 (c) A person, including a school district employee, whose
3333 employment is suspended or terminated, [or] who is otherwise
3434 discriminated against, or who suffers any other adverse employment
3535 action in violation of this section may sue for injunctive relief,
3636 damages, or both if, in violation of this section, the employee:
3737 (1) is suspended or terminated from employment;
3838 (2) i
3939 s discriminated against; or
4040 (3) suffers any other adverse personnel action.
4141 SECTION 2. This Act applies only to an adverse personnel
4242 action taken by an employer against an employee that occurs on or
4343 after the effective date of this Act. An adverse personnel action
4444 taken by an employer against an employee that occurs before that
4545 date is governed by the law in effect on the date the action
4646 occurred, and the former law is continued in effect for that
4747 purpose.
4848 SECTION 3. This Act takes effect December 1, 2017.
