66 AN ACT
77 relating to the use of a mobile phone by a person near a polling
88 place.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 61.014, Election Code, is amended by
1111 amending Subsections (a) and (b) and adding Subsection (e) to read
1212 as follows:
1313 (a) Except as otherwise provided by this section, a [A]
1414 person may not use a wireless communication device within 100 feet
1515 of a voting station.
1616 (b) A person may not use any mechanical or electronic means
1717 to take photographs, take video, or record [of recording images or]
1818 sound within 100 feet of a voting station.
1919 (e) A person may use the person's mobile phone to access
2020 information.
2121 SECTION 2. The heading to Section 62.0111, Election Code,
2222 is amended to read as follows:
2323 Sec. 62.0111. NOTICE OF PROHIBITION OF RECORDING [CERTAIN
2424 DEVICES].
2525 SECTION 3. Section 62.0111(a), Election Code, is amended to
2626 read as follows:
2727 (a) At the discretion of the presiding judge, notice of the
2828 prohibition of taking photographs, taking video, or recording sound
2929 [the use of certain devices] under Section 61.014 may be posted at
3030 one or more locations in the polling place where it can be read by
3131 persons waiting to vote.
3232 SECTION 4. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect on the 91st day after the last day of the
3737 legislative session.
