55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the small-sized district adjustment under the
88 Foundation School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 42.103(b) and (d), Education Code, are
1111 amended to read as follows:
1212 (b) The basic allotment of a school district that [contains
1313 at least 300 square miles and] has not more than 1,600 students in
1414 average daily attendance is adjusted by applying the formula:
1515 AA = (1 + ((1,600 - ADA) X .0004)) X ABA
1616 (d) The basic allotment of a school district that offers a
1717 kindergarten through grade 12 program and has less than 5,000
1818 students in average daily attendance is adjusted by applying the
1919 formula, of the following formulas, that results in the greatest
2020 adjusted allotment:
2121 (1) the formula in Subsection (b), if [or (c) for
2222 which] the district is eligible for that formula; or
2323 (2) AA = (1 + ((5,000 - ADA) X .000025)) X ABA.
2424 SECTION 2. Section 42.103(c), Education Code, is repealed.
2525 SECTION 3. This Act takes effect September 1, 2017, if this
2626 Act receives a vote of two-thirds of all the members elected to each
2727 house, as provided by Section 39, Article III, Texas Constitution.
2828 If this Act does not receive the vote necessary for effect on that
2929 date, this Act takes effect on the 91st day after the last day of the
3030 legislative session.
