7 | 7 | relating to an assessment of the safety and regulation of municipal | |
8 | 8 | solid waste facilities. | |
9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. In this Act: | |
11 | 11 | (1) "Commission" means the Texas Commission on | |
12 | 12 | Environmental Quality. | |
13 | 13 | (2) "Solid waste facility" has the meaning assigned by | |
14 | 14 | Section 361.003, Health and Safety Code. | |
15 | 15 | SECTION 2. (a) The commission shall conduct an assessment | |
16 | 16 | of the safety and regulation of municipal solid waste facilities in | |
17 | 17 | this state. The assessment must consider: | |
18 | 18 | (1) the permit application and approval process; | |
19 | 19 | (2) restrictions regarding the location of municipal | |
20 | 20 | solid waste facilities; | |
21 | 21 | (3) inspections and enforcement of regulations | |
22 | 22 | regarding municipal solid waste facilities; and | |
23 | 23 | (4) any other matters the commission considers | |
24 | 24 | appropriate. | |
25 | 25 | (b) Not later than December 1, 2018, the commission shall | |
26 | 26 | provide to each standing committee of the legislature with primary | |
27 | 27 | jurisdiction over environmental regulation a detailed written | |
28 | 28 | report regarding the assessment conducted under this section. | |
29 | 29 | SECTION 3. This Act takes effect December 1, 2017. |
