77 relating to the proof of citizenship or lawful presence in the
88 United States required for the issuance of a driver's license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 521.142(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) An application for an original license must state the
1313 applicant's full name and place and date of birth. This
1414 information must be verified by presentation of proof of identity
1515 satisfactory to the department. An applicant who is not a citizen
1616 of the United States must present to the department documentation
1717 issued by the appropriate United States agency that authorizes the
1818 applicant to be in the United States before the applicant may be
1919 issued a driver's license. The department must accept as
2020 satisfactory proof of identity under this subsection an offender
2121 identification card or similar form of identification issued to an
2222 inmate by the Texas Department of Criminal Justice if the applicant
2323 also provides supplemental verifiable records or documents that aid
2424 in establishing identity. For the purposes of this subsection, a
2525 voter registration certificate is not satisfactory proof of
2626 authorization to be in the United States.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect December 1, 2017.
