| 7 | 7 | | relating to the proof of citizenship or lawful presence in the |

| 8 | 8 | | United States required for the issuance of a driver's license. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 521.142(a), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) An application for an original license must state the |
|---|
| 13 | 13 | | applicant's full name and place and date of birth. This |
|---|
| 14 | 14 | | information must be verified by presentation of proof of identity |
|---|
| 15 | 15 | | satisfactory to the department. An applicant who is not a citizen |
|---|
| 16 | 16 | | of the United States must present to the department documentation |
|---|
| 17 | 17 | | issued by the appropriate United States agency that authorizes the |
|---|
| 18 | 18 | | applicant to be in the United States before the applicant may be |
|---|
| 19 | 19 | | issued a driver's license. The department must accept as |
|---|
| 20 | 20 | | satisfactory proof of identity under this subsection an offender |
|---|
| 21 | 21 | | identification card or similar form of identification issued to an |
|---|
| 22 | 22 | | inmate by the Texas Department of Criminal Justice if the applicant |
|---|
| 23 | 23 | | also provides supplemental verifiable records or documents that aid |
|---|
| 24 | 24 | | in establishing identity. For the purposes of this subsection, a |
|---|
| 25 | 25 | | voter registration certificate is not satisfactory proof of |
|---|
| 26 | 26 | | authorization to be in the United States. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect December 1, 2017. |
