66 AN ACT
77 relating to the sparsity adjustment for certain school districts
88 under the Foundation School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.105, Education Code, is amended by
1111 adding Subsection (a-1) to read as follows:
1212 (a-1) Notwithstanding Subsection (a), a school district
1313 that is the only district operating a campus in a county and
1414 operates:
1515 (1) a kindergarten through grade 12 program whose
1616 preceding or current year's average daily attendance is less than
1717 130 students shall be provided an adjusted basic allotment on the
1818 basis of 130 students in average daily attendance;
1919 (2) a kindergarten through grade 8 program whose
2020 preceding or current year's average daily attendance is less than
2121 75 students shall be provided an adjusted basic allotment on the
2222 basis of 75 students in average daily attendance; and
2323 (3) a kindergarten through grade 6 program whose
2424 preceding or current year's average daily attendance is less than
2525 60 students shall be provided an adjusted basic allotment on the
2626 basis of 60 students in average daily attendance.
2727 SECTION 2. This Act takes effect September 1, 2017, if it
2828 receives a vote of two-thirds of all the members elected to each
2929 house, as provided by Section 39, Article III, Texas Constitution.
3030 If this Act does not receive that vote, this Act takes effect on the
3131 91st day after the last day of the legislative session.
