| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 42.105, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (a-1) to read as follows: |
|---|
| 12 | 12 | | (a-1) Notwithstanding Subsection (a), a school district |
|---|
| 13 | 13 | | that is the only district operating a campus in a county and |
|---|
| 14 | 14 | | operates: |
|---|
| 15 | 15 | | (1) a kindergarten through grade 12 program whose |
|---|
| 16 | 16 | | preceding or current year's average daily attendance is less than |
|---|
| 17 | 17 | | 130 students shall be provided an adjusted basic allotment on the |
|---|
| 18 | 18 | | basis of 130 students in average daily attendance; |
|---|
| 19 | 19 | | (2) a kindergarten through grade 8 program whose |
|---|
| 20 | 20 | | preceding or current year's average daily attendance is less than |
|---|
| 21 | 21 | | 75 students shall be provided an adjusted basic allotment on the |
|---|
| 22 | 22 | | basis of 75 students in average daily attendance; and |
|---|
| 23 | 23 | | (3) a kindergarten through grade 6 program whose |
|---|
| 24 | 24 | | preceding or current year's average daily attendance is less than |
|---|
| 25 | 25 | | 60 students shall be provided an adjusted basic allotment on the |
|---|
| 26 | 26 | | basis of 60 students in average daily attendance. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2017, if it |
|---|
| 28 | 28 | | receives a vote of two-thirds of all the members elected to each |
|---|
| 29 | 29 | | house, as provided by Section 39, Article III, Texas Constitution. |
|---|
| 30 | 30 | | If this Act does not receive that vote, this Act takes effect on the |
|---|
| 31 | 31 | | 91st day after the last day of the legislative session. |
