66 AN ACT
77 relating to a prohibition of the land application of grease or grit
88 trap waste.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 361.121(a)(2), Health and Safety Code,
1111 is amended to read as follows:
1212 (2) "Land application unit" means an area where wastes
1313 are applied onto or incorporated into the soil surface for
1414 agricultural purposes or for treatment and disposal. The term does
1515 not include manure spreading operations or placement of waste on a
1616 liner registered or permitted by the commission.
1717 SECTION 2. Subchapter C, Chapter 361, Health and Safety
1818 Code, is amended by adding Section 361.1215 to read as follows:
1919 Sec. 361.1215. LAND APPLICATION OF GRIT AND GREASE TRAP
2020 WASTE PROHIBITED. (a) In this section:
2121 (1) "Grease trap waste" means a material collected in
2222 and from a grease interceptor in the sanitary sewer line of a
2323 commercial, institutional, or industrial food service or
2424 processing facility. The term includes the solids resulting from a
2525 dewatering process.
2626 (2) "Grit trap" means a unit or chamber that:
2727 (A) allows the sedimentation of solids from an
2828 influent liquid stream by reducing the flow velocity of the stream;
2929 (B) has an inlet and outlet that are both located
3030 at the same vertical level at or near the top of the unit or chamber;
3131 (C) has an outlet that is connected to a sanitary
3232 sewer system; and
3333 (D) is not designed to separate oil and water.
3434 (3) "Grit trap waste" means the waste collected in a
3535 grit trap. The term includes waste from an interceptor placed in a
3636 drain at maintenance and repair shops, automobile service stations,
3737 car washes, laundries, and other similar facilities.
3838 (b) The commission may not issue a permit, registration, or
3939 other authorization for land application of grease trap waste or
4040 grit trap waste.
4141 (c) This section does not apply to:
4242 (1) the disposal of grease trap waste or grit trap
4343 waste at a municipal solid waste Type I landfill permitted by the
4444 commission;
4545 (2) the processing of grease trap waste or grit trap
4646 waste at a municipal solid waste Type V compost facility permitted
4747 or registered by the commission; or
4848 (3) land application of Grade 1 or Grade 2 compost
4949 generated at a Type V compost facility permitted to compost grease
5050 trap waste by the commission.
5151 SECTION 3. A permit, registration, or other authorization
5252 issued by the Texas Commission on Environmental Quality that allows
5353 the land application of grease trap waste or grit trap waste expires
5454 on the effective date of this Act. The remainder of a permit,
5555 registration, or other authorization that contains items in
5656 addition to an authorization allowing the land application of
5757 grease trap waste or grit trap waste remains in effect to the extent
5858 that it does not authorize the land application of grease trap waste
5959 or grit trap waste.
6060 SECTION 4. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect December 1, 2017.
