6	6	AN ACT
7	7	relating to a prohibition of the land application of grease or grit
8	8	trap waste.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 361.121(a)(2), Health and Safety Code,
11	11	is amended to read as follows:
12	12	(2) "Land application unit" means an area where wastes
13	13	are applied onto or incorporated into the soil surface for
14	14	agricultural purposes or for treatment and disposal. The term does
15	15	not include manure spreading operations or placement of waste on a
16	16	liner registered or permitted by the commission.
17	17	SECTION 2. Subchapter C, Chapter 361, Health and Safety
18	18	Code, is amended by adding Section 361.1215 to read as follows:
19	19	Sec. 361.1215. LAND APPLICATION OF GRIT AND GREASE TRAP
20	20	WASTE PROHIBITED. (a) In this section:
21	21	(1) "Grease trap waste" means a material collected in
22	22	and from a grease interceptor in the sanitary sewer line of a
23	23	commercial, institutional, or industrial food service or
24	24	processing facility. The term includes the solids resulting from a
25	25	dewatering process.
26	26	(2) "Grit trap" means a unit or chamber that:
27	27	(A) allows the sedimentation of solids from an
28	28	influent liquid stream by reducing the flow velocity of the stream;
29	29	(B) has an inlet and outlet that are both located
30	30	at the same vertical level at or near the top of the unit or chamber;
31	31	(C) has an outlet that is connected to a sanitary
32	32	sewer system; and
33	33	(D) is not designed to separate oil and water.
34	34	(3) "Grit trap waste" means the waste collected in a
35	35	grit trap. The term includes waste from an interceptor placed in a
36	36	drain at maintenance and repair shops, automobile service stations,
37	37	car washes, laundries, and other similar facilities.
38	38	(b) The commission may not issue a permit, registration, or
39	39	other authorization for land application of grease trap waste or
40	40	grit trap waste.
41	41	(c) This section does not apply to:
42	42	(1) the disposal of grease trap waste or grit trap
43	43	waste at a municipal solid waste Type I landfill permitted by the
44	44	commission;
45	45	(2) the processing of grease trap waste or grit trap
46	46	waste at a municipal solid waste Type V compost facility permitted
47	47	or registered by the commission; or
48	48	(3) land application of Grade 1 or Grade 2 compost
49	49	generated at a Type V compost facility permitted to compost grease
50	50	trap waste by the commission.
51	51	SECTION 3. A permit, registration, or other authorization
52	52	issued by the Texas Commission on Environmental Quality that allows
53	53	the land application of grease trap waste or grit trap waste expires
54	54	on the effective date of this Act. The remainder of a permit,
55	55	registration, or other authorization that contains items in
56	56	addition to an authorization allowing the land application of
57	57	grease trap waste or grit trap waste remains in effect to the extent
58	58	that it does not authorize the land application of grease trap waste
59	59	or grit trap waste.
60	60	SECTION 4. This Act takes effect immediately if it receives
61	61	a vote of two-thirds of all the members elected to each house, as
62	62	provided by Section 39, Article III, Texas Constitution. If this
63	63	Act does not receive the vote necessary for immediate effect, this
64	64	Act takes effect December 1, 2017.
