7 | 7 | | relating to the screening of certain women for substance use and |

8 | 8 | | postpartum depression. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 32, Health and Safety Code, is amended by |
---|
11 | 11 | | adding Subchapter E to read as follows: |

12 | 12 | | SUBCHAPTER E. SUBSTANCE USE AND POSTPARTUM DEPRESSION SCREENING |
---|
13 | 13 | | Sec. 32.081. SUBSTANCE USE AND POSTPARTUM DEPRESSION |
---|
14 | 14 | | SCREENING OF CERTAIN WOMEN. (a) A physician or other person |
---|
15 | 15 | | authorized by law to attend a pregnant woman or woman who has been |
---|
16 | 16 | | pregnant at any time during the preceding year shall screen the |
---|
17 | 17 | | woman for substance use and postpartum depression. |
---|
18 | 18 | | (b) The commission shall make available to physicians and |
---|
19 | 19 | | other persons required to conduct a screening under Subsection (a) |
---|
20 | 20 | | information that includes: |
---|
21 | 21 | | (1) guidance regarding the process for verbally |
---|
22 | 22 | | screening a pregnant woman for substance use or a woman who has been |
---|
23 | 23 | | pregnant for postpartum depression using a standardized and |
---|
24 | 24 | | validated screening tool; and |
---|
25 | 25 | | (2) a list of substance use and postpartum depression |
---|
26 | 26 | | treatment resources in each geographic region of this state. |
---|
27 | 27 | | (c) A physician or other person described by Subsection (a) |
---|
28 | 28 | | is not required to comply with that subsection if the physician or |
---|
29 | 29 | | other person determines compliance is not possible or would |
---|
30 | 30 | | otherwise be inappropriate. |
---|
31 | 31 | | SECTION 2. As soon as practicable after the effective date |
---|
32 | 32 | | of this Act, the executive commissioner of the Health and Human |
---|
33 | 33 | | Services Commission shall adopt rules necessary to implement the |
---|
34 | 34 | | changes in law made by this Act. |
---|
35 | 35 | | SECTION 3. (a) Not later than June 1, 2018, the Health and |
---|
36 | 36 | | Human Services Commission shall make the information described by |
---|
37 | 37 | | Section 32.081, Health and Safety Code, as added by this Act, |
---|
38 | 38 | | available to physicians and other persons authorized by law to |
---|
39 | 39 | | attend a pregnant woman or a woman who has been pregnant at any time |
---|
40 | 40 | | during the preceding year. |
---|
41 | 41 | | (b) A physician or other person described by Subsection (a) |
---|
42 | 42 | | of this section is not required to conduct the screenings described |
---|
43 | 43 | | by Section 32.081, Health and Safety Code, as added by this Act, |
---|
44 | 44 | | before December 1, 2018. |
---|
45 | 45 | | SECTION 4. This Act takes effect on the 91st day after the |
---|
46 | 46 | | last day of the legislative session. |
