55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the screening of certain women for substance use and
88 postpartum depression.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 32, Health and Safety Code, is amended by
1111 adding Subchapter E to read as follows:
1212 SUBCHAPTER E. SUBSTANCE USE AND POSTPARTUM DEPRESSION SCREENING
1313 Sec. 32.081. SUBSTANCE USE AND POSTPARTUM DEPRESSION
1414 SCREENING OF CERTAIN WOMEN. (a) A physician or other person
1515 authorized by law to attend a pregnant woman or woman who has been
1616 pregnant at any time during the preceding year shall screen the
1717 woman for substance use and postpartum depression.
1818 (b) The commission shall make available to physicians and
1919 other persons required to conduct a screening under Subsection (a)
2020 information that includes:
2121 (1) guidance regarding the process for verbally
2222 screening a pregnant woman for substance use or a woman who has been
2323 pregnant for postpartum depression using a standardized and
2424 validated screening tool; and
2525 (2) a list of substance use and postpartum depression
2626 treatment resources in each geographic region of this state.
2727 (c) A physician or other person described by Subsection (a)
2828 is not required to comply with that subsection if the physician or
2929 other person determines compliance is not possible or would
3030 otherwise be inappropriate.
3131 SECTION 2. As soon as practicable after the effective date
3232 of this Act, the executive commissioner of the Health and Human
3333 Services Commission shall adopt rules necessary to implement the
3434 changes in law made by this Act.
3535 SECTION 3. (a) Not later than June 1, 2018, the Health and
3636 Human Services Commission shall make the information described by
3737 Section 32.081, Health and Safety Code, as added by this Act,
3838 available to physicians and other persons authorized by law to
3939 attend a pregnant woman or a woman who has been pregnant at any time
4040 during the preceding year.
4141 (b) A physician or other person described by Subsection (a)
4242 of this section is not required to conduct the screenings described
4343 by Section 32.081, Health and Safety Code, as added by this Act,
4444 before December 1, 2018.
4545 SECTION 4. This Act takes effect on the 91st day after the
4646 last day of the legislative session.
