| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 39, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 39.0531 to read as follows: |
|---|
| 12 | 12 | | Sec. 39.0531. STUDENTS EVALUATED FOR PURPOSES OF |
|---|
| 13 | 13 | | ACCOUNTABILITY RATINGS IN CERTAIN SCHOOL DISTRICTS. (a) This |
|---|
| 14 | 14 | | section applies only to a school district that includes a student |
|---|
| 15 | 15 | | enrollment of at least 1,000 African American males. |
|---|
| 16 | 16 | | (b) Notwithstanding any other law, for purposes of |
|---|
| 17 | 17 | | evaluating under Sections 39.053(c)(1) and (2)(A) the performance |
|---|
| 18 | 18 | | of a school district subject to this section and campuses in a |
|---|
| 19 | 19 | | school district subject to this section, only the performance of |
|---|
| 20 | 20 | | African American males may be considered. |
|---|
| 21 | 21 | | (c) Notwithstanding any other law, for purposes of |
|---|
| 22 | 22 | | evaluating under Section 39.053(c)(3) the performance of a school |
|---|
| 23 | 23 | | district subject to this section and campuses in a school district |
|---|
| 24 | 24 | | subject to this section, only the student academic achievement |
|---|
| 25 | 25 | | differentials among African American males from different |
|---|
| 26 | 26 | | socioeconomic backgrounds may be considered. |
|---|
| 27 | 27 | | SECTION 2. This Act applies beginning with the 2017-2018 |
|---|
| 28 | 28 | | school year. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect December 1, 2017. |
