55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to maternal health care.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 32, Health and Safety
1010 Code, is amended by adding Section 32.022 to read as follows:
1111 Sec. 32.022. WOMEN'S HEALTH CAMPAIGN. The commission, in
1212 collaboration with the department and other interested parties,
1313 shall create a campaign to educate women about the importance of
1414 prenatal care.
1515 SECTION 2. Section 34.005, Health and Safety Code, is
1616 amended to read as follows:
1717 Sec. 34.005. DUTIES OF TASK FORCE. The task force shall:
1818 (1) study and review:
1919 (A) cases of pregnancy-related deaths; [and]
2020 (B) trends, rates, or disparities in
2121 pregnancy-related deaths, postpartum depression, behavioral health
2222 diagnoses, and [in] severe maternal morbidity;
2323 (C) health conditions and factors that
2424 disproportionately affect the most at-risk population as
2525 determined in the task force's biennial report required under
2626 Section 34.015; and
2727 (D) best practices and programs operating in
2828 other states that have reduced rates of pregnancy-related deaths;
2929 (2) determine the feasibility of the task force
3030 studying cases of severe maternal morbidity; and
3131 (3) make recommendations to help reduce the incidence
3232 of pregnancy-related deaths and severe maternal morbidity in this
3333 state.
3434 SECTION 3. Chapter 34, Health and Safety Code, is amended by
3535 adding Sections 34.0155, 34.0156, and 34.0157 to read as follows:
3636 Sec. 34.0155. REPORT ON PREGNANCY-RELATED DEATHS AND
3737 POSTPARTUM DEPRESSION. The commission shall:
3838 (1) evaluate options for reducing pregnancy-related
3939 deaths, focusing on the most prevalent causes of pregnancy-related
4040 deaths as identified in the task force's biennial report required
4141 under Section 34.015, and for treating postpartum depression in
4242 economically disadvantaged women; and
4343 (2) submit a written report summarizing the
4444 commission's, department's, and task force's efforts to accomplish
4545 the tasks described by Subdivision (1) to the governor, the
4646 lieutenant governor, the speaker of the house of representatives,
4747 the Legislative Budget Board, and the appropriate standing
4848 committees of the legislature not later than December 1 of each
4949 even-numbered year.
5050 Sec. 34.0156. REPORT ON ACTIONS TO ADDRESS MATERNAL
5151 MORTALITY RATES. Not later than December 1 of each even-numbered
5252 year, the commission shall submit to the governor, the lieutenant
5353 governor, the speaker of the house of representatives, the
5454 Legislative Budget Board, and the appropriate standing committees
5555 of the legislature a written report summarizing the actions taken
5656 to address maternal morbidity and reduce maternal mortality rates.
5757 The report must include information from programs and initiatives
5858 created to address maternal morbidity and reduce maternal mortality
5959 rates in this state, including:
6060 (1) Medicaid as defined by Section 531.001, Government
6161 Code;
6262 (2) the children's health insurance program, including
6363 the perinatal program;
6464 (3) the Healthy Texas Women program;
6565 (4) the Family Planning Program;
6666 (5) this state's program under the Maternal and Child
6767 Health Services Block Grant Act (42 U.S.C. Section 701 et seq.);
6868 (6) the Perinatal Advisory Council;
6969 (7) state health plans; and
7070 (8) the Healthy Texas Babies program.
7171 Sec. 34.0157. PROGRAM EVALUATIONS; RESOURCE GUIDE; PILOT
7272 PROGRAM. (a) The task force, under the direction of the
7373 commission, shall:
7474 (1) explore options for expanding the pilot program
7575 for pregnancy medical homes under Section 531.0996, Government
7676 Code;
7777 (2) explore the possibility of increasing the benefits
7878 provided under state-administered health programs, including
7979 specialty care and prescriptions, for women who are at greater risk
8080 of having a high-risk pregnancy or premature delivery;
8181 (3) evaluate supplemental payments to obstetrics
8282 providers for pregnancy risk assessments and evaluate the
8383 submission of a waiver to fund managed care organization payments
8484 for case management and care coordination services for women at
8585 high risk of severe maternal morbidity on conclusion of their
8686 eligibility for Medicaid as defined by Section 531.001, Government
8787 Code;
8888 (4) evaluate the length of time to complete the
8989 Medicaid enrollment process for pregnant women;
9090 (5) evaluate the use for Medicaid of Medicare codes
9191 for care coordination; and
9292 (6) study the impact of the programs funded from the
9393 Teen Pregnancy Prevention Program federal grant and whether the
9494 state should continue funding the programs.
9595 (b) The commission shall:
9696 (1) create and maintain an online resource guide of
9797 mental and behavioral health providers to assist women who have
9898 limited or no health benefit plan coverage or mental health benefit
9999 plan coverage in finding affordable providers; and
100100 (2) create a pilot program for managed care
101101 organizations to use community health workers to address the needs
102102 of women who have a high-risk condition, including:
103103 (A) substance use disorder;
104104 (B) cardiovascular disease; and
105105 (C) hypertension.
106106 SECTION 4. Chapter 34, Health and Safety Code, is amended by
107107 adding Section 34.019 to read as follows:
108108 Sec. 34.019. DATA COLLECTION. The task force, under the
109109 direction of the commission, shall collect information relating to
110110 maternity care and postpartum depression in this state, including
111111 the:
112112 (1) total number of births to Medicaid recipients;
113113 (2) number of women who are screened for postpartum
114114 depression as a Medicaid recipient;
115115 (3) total number of births to women with health
116116 benefit plan coverage;
117117 (4) number of women with health benefit plan coverage
118118 who are screened for postpartum depression;
119119 (5) number of women with health benefit plan coverage
120120 who are treated for postpartum depression;
121121 (6) number of women screened for postpartum depression
122122 under the Healthy Texas Women program;
123123 (7) number of women treated for postpartum depression
124124 under the Healthy Texas Women program;
125125 (8) number of claims for postpartum depression
126126 treatment paid by the Healthy Texas Women program;
127127 (9) number of claims for postpartum depression
128128 treatment rejected by the Healthy Texas Women program;
129129 (10) postpartum depression screening and treatment
130130 billing codes and the number of claims for each billing code under
131131 the Healthy Texas Women program;
132132 (11) number of days between the date of a postpartum
133133 depression screening and the date the patient begins treatment
134134 under Medicaid;
135135 (12) number of days between the date of a postpartum
136136 depression screening and the date the patient begins treatment
137137 under the Healthy Texas Women program;
138138 (13) number of women who screen positive for
139139 postpartum depression under Medicaid and the length of time
140140 following childbirth for the screening to occur;
141141 (14) number of women with health benefit plan coverage
142142 who screen positive for postpartum depression and the length of
143143 time following childbirth for the screening to occur; and
144144 (15) number of women who screen positive for
145145 postpartum depression under the Healthy Texas Women program and the
146146 length of time following childbirth for the screening to occur.
147147 SECTION 5. Section 34.018, Health and Safety Code, is
148148 amended to read as follows:
149149 Sec. 34.018. SUNSET PROVISION. The task force is subject to
150150 Chapter 325, Government Code (Texas Sunset Act). Unless continued
151151 in existence as provided by that chapter, the task force is
152152 abolished and this chapter expires September 1, 2023 [2019].
153153 SECTION 6. This Act takes effect immediately if it receives
154154 a vote of two-thirds of all the members elected to each house, as
155155 provided by Section 39, Article III, Texas Constitution. If this
156156 Act does not receive the vote necessary for immediate effect, this
157157 Act takes effect on the 91st day after the last day of the
158158 legislative session.
