55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a reduction of the amount required to be paid by certain
88 school districts to achieve the equalized wealth level under the
99 public school finance system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 41, Education Code, is
1212 amended by adding Section 41.0933 to read as follows:
1313 Sec. 41.0933. REDUCTION FOR MAINTENANCE AND OPERATIONS
1414 COSTS. (a) This section applies only to a school district in which
1515 at least 65 percent of the enrolled students are educationally
1616 disadvantaged or at risk of dropping out of school, as defined by
1717 Section 29.081(d).
1818 (b) Notwithstanding any other provision of this chapter, a
1919 school district to which this section applies that executes an
2020 agreement to purchase all attendance credits necessary to reduce
2121 the district's wealth per student to the equalized wealth level may
2222 reduce the total amount required to be paid for attendance credits
2323 under Section 41.093 by 25 percent.
2424 (c) A reduction under Subsection (b) shall be made after
2525 making any reduction to which the district is entitled under
2626 Section 41.0931, 41.097, or 41.098 or another provision of this
2727 chapter.
2828 (d) The district shall use amounts available to the district
2929 as a result of this section to pay district maintenance and
3030 operations costs.
3131 SECTION 2. This Act takes effect September 1, 2017, if this
3232 Act receives a vote of two-thirds of all the members elected to each
3333 house, as provided by Section 39, Article III, Texas Constitution.
3434 If this Act does not receive the vote necessary for effect on that
3535 date, this Act takes effect on the 91st day after the last day of the
3636 legislative session.
