66 AN ACT
77 relating to the adoption of teacher performance contracts for
88 classroom teachers and an increased basic allotment for school
99 districts that adopt those contracts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 21, Education Code, is amended by adding
1212 Subchapter H-1 to read as follows:
1313 SUBCHAPTER H-1. TEACHER PERFORMANCE CONTRACTS
1414 Sec. 21.371. TEACHER PERFORMANCE CONTRACTS. (a) A school
1515 district may adopt teacher performance contracts under this
1616 subchapter for use in the district for the purpose of providing
1717 specific guidance to classroom teachers on improving performance.
1818 (b) A district that adopts teacher performance contracts
1919 under this subchapter must use a teacher performance contract
2020 evaluation system described by Section 21.372.
2121 (c) A teacher performance contract under this subchapter is
2222 a supplemental agreement between the district and teacher and does
2323 not affect the requirements under this chapter to employ a teacher
2424 under a probationary, continuing, or term contract.
2525 Sec. 21.372. TEACHER PERFORMANCE CONTRACT EVALUATION
2626 SYSTEM. (a) A teacher performance contract evaluation system
2727 consists of an appraisal process and performance criteria adopted
2828 in accordance with Section 21.352(a)(2) that include evaluation
2929 based on:
3030 (1) observation of the teacher's performance;
3131 (2) student achievement results, as measured by
3232 student growth and performance on multiple tests and school growth
3333 and performance on state assessment instruments administered under
3434 Section 39.023; and
3535 (3) research-based, age-appropriate surveys
3636 administered to students about the teacher's performance.
3737 (b) The evaluation system described by this section must
3838 provide that a classroom teacher's performance on each criteria
3939 listed in Subsection (a)(1), (2), or (3) is weighted not less than
4040 15 percent of the teacher's appraisal.
4141 (c) The evaluation system described by this section must
4242 provide not fewer than eight performance levels to which a
4343 classroom teacher may be assigned based on the teacher's appraisal.
4444 Sec. 21.373. ADDITIONAL COMPENSATION BASED ON APPRAISAL
4545 PERFORMANCE LEVEL. (a) A teacher performance contract must
4646 provide for additional compensation for a classroom teacher
4747 assigned a performance level under the evaluation system described
4848 by Section 21.372 that indicates the teacher's performance exceeds
4949 the performance expected at the teacher's level of experience.
5050 (b) The contract must ensure that the salary of a teacher
5151 described by Subsection (a) exceeds the compensation the teacher is
5252 entitled to under the minimum salary schedule provided by Section
5353 21.402.
5454 Sec. 21.374. CERTAIN EMPLOYMENT RENEWAL PROHIBITED. (a) A
5555 school district that adopts teacher performance contracts under
5656 this subchapter may not renew the employment contract of a
5757 classroom teacher employed under a probationary contract who is
5858 assigned the minimum performance level based on the teacher's
5959 appraisal for the school year, except as otherwise provided by
6060 Subsection (b).
6161 (b) The board of trustees of a school district may take
6262 specific action to renew the employment of a teacher who is employed
6363 under a probationary contract and is assigned the minimum
6464 performance level based on the teacher's appraisal for the school
6565 year.
6666 Sec. 21.375. COMMISSIONER APPROVAL. The commissioner shall
6767 approve a school district for purposes of the adjustment in the
6868 district's basic allotment provided by Section 42.101(d) if the
6969 commissioner determines that:
7070 (1) the district has met the requirements for teacher
7171 performance contracts provided by this subchapter; and
7272 (2) the teacher performance contracts adopted by the
7373 district satisfy any commissioner rules adopted to ensure that
7474 teacher performance contracts are likely to improve the district's:
7575 (A) recruitment of effective classroom teachers;
7676 (B) retention of effective classroom teachers;
7777 and
7878 (C) student performance.
7979 Sec. 21.376. RULES. The commissioner may adopt rules to
8080 implement this subchapter.
8181 SECTION 2. Section 42.101, Education Code, is amended by
8282 adding Subsection (d) to read as follows:
8383 (d) Notwithstanding any other provision of this section,
8484 for a school district that adopts teacher performance contracts
8585 under Subchapter H-1, Chapter 21, and receives commissioner
8686 approval under Section 21.375, the basic allotment to which the
8787 district would otherwise be entitled under this section is
8888 increased by the amount that results from the following formula:
8989 I = $50 X (PCE/TE)
9090 where:
9191 "I" is the amount by which the district's basic allotment is
9292 increased under this subsection;
9393 "PCE" is the number of classroom teachers employed by the
9494 district that have entered a teacher performance contract with the
9595 district; and
9696 "TE" is the total number of classroom teachers employed by
9797 the district.
9898 SECTION 3. This Act applies beginning with the 2018-2019
9999 school year.
100100 SECTION 4. This Act takes effect December 1, 2017.
