| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 41.094(b), Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (b) Receipts shall be deposited in the state treasury to the |
|---|
| 12 | 12 | | credit of the attendance credit receipts fund under Section 41.0941 |
|---|
| 13 | 13 | | [and may be used only for foundation school program purposes]. |
|---|
| 14 | 14 | | SECTION 2. Subchapter D, Chapter 41, Education Code, is |
|---|
| 15 | 15 | | amended by adding Section 41.0941 to read as follows: |
|---|
| 16 | 16 | | Sec. 41.0941. ATTENDANCE CREDIT RECEIPTS FUND. (a) The |
|---|
| 17 | 17 | | attendance credit receipts fund is created as a fund in the state |
|---|
| 18 | 18 | | treasury, administered by the comptroller. |
|---|
| 19 | 19 | | (b) The attendance credit receipts fund shall consist of |
|---|
| 20 | 20 | | payments made by school districts under Section 41.094 for the |
|---|
| 21 | 21 | | purchase of attendance credits under this subchapter. |
|---|
| 22 | 22 | | (c) Money deposited to the attendance credit receipts fund |
|---|
| 23 | 23 | | may only be used for foundation school program purposes. |
|---|
| 24 | 24 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 25 | 25 | | of this Act, the comptroller shall transfer from the general |
|---|
| 26 | 26 | | revenue fund to the attendance credit receipts fund created under |
|---|
| 27 | 27 | | Section 41.0941, Education Code, as added by this Act, any funds |
|---|
| 28 | 28 | | received from the purchase of attendance credits by a school |
|---|
| 29 | 29 | | district under Section 41.094, Education Code, before the effective |
|---|
| 30 | 30 | | date of this Act. |
|---|
| 31 | 31 | | SECTION 4. This Act takes effect December 1, 2017. |
