66 AN ACT
77 relating to the creation of the attendance credit receipts fund.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 41.094(b), Education Code, is amended to
1010 read as follows:
1111 (b) Receipts shall be deposited in the state treasury to the
1212 credit of the attendance credit receipts fund under Section 41.0941
1313 [and may be used only for foundation school program purposes].
1414 SECTION 2. Subchapter D, Chapter 41, Education Code, is
1515 amended by adding Section 41.0941 to read as follows:
1616 Sec. 41.0941. ATTENDANCE CREDIT RECEIPTS FUND. (a) The
1717 attendance credit receipts fund is created as a fund in the state
1818 treasury, administered by the comptroller.
1919 (b) The attendance credit receipts fund shall consist of
2020 payments made by school districts under Section 41.094 for the
2121 purchase of attendance credits under this subchapter.
2222 (c) Money deposited to the attendance credit receipts fund
2323 may only be used for foundation school program purposes.
2424 SECTION 3. As soon as practicable after the effective date
2525 of this Act, the comptroller shall transfer from the general
2626 revenue fund to the attendance credit receipts fund created under
2727 Section 41.0941, Education Code, as added by this Act, any funds
2828 received from the purchase of attendance credits by a school
2929 district under Section 41.094, Education Code, before the effective
3030 date of this Act.
3131 SECTION 4. This Act takes effect December 1, 2017.
