| 7 | 7 | | relating to the regulation of certain industrialized housing and |
|---|
| 8 | 8 | | industrialized buildings. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1202.002(c), Occupations Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) Industrialized housing does not include: |
|---|
| 13 | 13 | | (1) a residential structure that exceeds 14 [four] |
|---|
| 14 | 14 | | stories or 168 [60] feet in height; |
|---|
| 15 | 15 | | (2) housing constructed of a sectional or panelized |
|---|
| 16 | 16 | | system that does not use a modular component; or |
|---|
| 17 | 17 | | (3) a ready-built home constructed in a manner in |
|---|
| 18 | 18 | | which the entire living area is contained in a single unit or |
|---|
| 19 | 19 | | section at a temporary location for the purpose of selling and |
|---|
| 20 | 20 | | moving the home to another location. |
|---|
| 21 | 21 | | SECTION 2. Section 1202.003(d), Occupations Code, is |
|---|
| 22 | 22 | | amended to read as follows: |
|---|
| 23 | 23 | | (d) An industrialized building includes a permanent |
|---|
| 24 | 24 | | commercial structure and a commercial structure designed to be |
|---|
| 25 | 25 | | transported from one commercial site to another commercial site but |
|---|
| 26 | 26 | | does not include: |
|---|
| 27 | 27 | | (1) a commercial structure that exceeds 14 [four] |
|---|
| 28 | 28 | | stories or 168 [60] feet in height; or |
|---|
| 29 | 29 | | (2) a commercial building or structure that is: |
|---|
| 30 | 30 | | (A) installed in a manner other than on a |
|---|
| 31 | 31 | | permanent foundation; and |
|---|
| 32 | 32 | | (B) either: |
|---|
| 33 | 33 | | (i) not open to the public; or |
|---|
| 34 | 34 | | (ii) less than 1,500 square feet in total |
|---|
| 35 | 35 | | area and used other than as a school or a place of religious |
|---|
| 36 | 36 | | worship. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect on the 91st day after the last day of the |
|---|
| 42 | 42 | | legislative session. |
