66 AN ACT
77 relating to a reduction of the amount required to be paid by certain
88 school districts to achieve the equalized wealth level under the
99 public school finance system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 41, Education Code, is
1212 amended by adding Section 41.0933 to read as follows:
1313 Sec. 41.0933. REDUCTION FOR LOSS OF FORMER FUNDING. (a)
1414 This section applies only to a school district that for the current
1515 school year would have been entitled to receive additional state
1616 aid for tax reduction under Section 42.2516, as that section
1717 existed January 1, 2017.
1818 (b) Notwithstanding any other provision of this chapter, a
1919 school district that executes an agreement to purchase all
2020 attendance credits necessary to reduce the district's wealth per
2121 student to the equalized wealth level may reduce the total amount
2222 required to be paid for attendance credits under Section 41.093 for
2323 a school year by the amount of additional state aid for tax
2424 reduction that the district would have been entitled to receive for
2525 that school year under Section 42.2516, as that section existed
2626 January 1, 2017.
2727 (c) A reduction under Subsection (b) is in addition to any
2828 other reduction to which the district is entitled under this code.
2929 (d) In implementing this section, the commissioner shall
3030 make determinations regarding additional state aid for tax
3131 reduction under Section 42.2516, as that section existed January 1,
3232 2017, using the percentage reduction for purposes of former Section
3333 42.2516(i) specified by appropriation for the 2016-2017 school
3434 year.
3535 (e) This section expires September 1, 2019.
3636 SECTION 2. This Act takes effect September 1, 2017, if it
3737 receives a vote of two-thirds of all the members elected to each
3838 house, as provided by Section 39, Article III, Texas Constitution.
3939 If this Act does not receive the vote necessary for effect on that
4040 date, this Act takes effect on the 91st day after the last day of the
4141 legislative session.
