| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 1575, Insurance Code, is |
|---|
| 12 | 12 | | amended by adding Section 1575.171 to read as follows: |
|---|
| 13 | 13 | | Sec. 1575.171. APPLICABILITY OF FORMER LAW. (a) |
|---|
| 14 | 14 | | Notwithstanding the change in law made by Chapter 712 (H.B. 3976), |
|---|
| 15 | 15 | | Acts of the 85th Legislature, Regular Session, 2017, the trustee |
|---|
| 16 | 16 | | shall continue to offer and administer the health benefit plan |
|---|
| 17 | 17 | | options offered under this chapter as it existed immediately before |
|---|
| 18 | 18 | | September 1, 2017, for participating retirees, dependents, |
|---|
| 19 | 19 | | surviving spouses, or surviving dependent children who are enrolled |
|---|
| 20 | 20 | | in a health benefit plan offered under the group program in the 2017 |
|---|
| 21 | 21 | | plan year, and the former law is continued in effect for that |
|---|
| 22 | 22 | | purpose. |

| 23 | 23 | | (b) The change in law made by Chapter 712 (H.B. 3976), Acts |
|---|
| 24 | 24 | | of the 85th Legislature, Regular Session, 2017, applies only to |
|---|
| 25 | 25 | | retirees, dependents, surviving spouses, or surviving dependent |
|---|
| 26 | 26 | | children who enroll in a health benefit plan offered under the group |
|---|
| 27 | 27 | | program beginning with the 2018 plan year or a subsequent plan year. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect December 1, 2017. |
|---|
