7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Subchapter D, Chapter 11, Education Code, is | |
9 | 9 | amended by adding Section 11.179 to read as follows: | |
10 | 10 | Sec. 11.179. CERTAIN DISCRIMINATION POLICIES PROHIBITED. | |
11 | 11 | (a) Except in accordance with federal law as enacted by Congress | |
12 | 12 | and interpreted in controlling federal case law and state law as | |
13 | 13 | enacted by the legislature and interpreted in controlling case law | |
14 | 14 | of this state, the board of trustees of a school district may not | |
15 | 15 | adopt or enforce a policy or other measure to protect a class of | |
16 | 16 | persons from discrimination to the extent that the policy or other | |
17 | 17 | measure regulates access to multiple-occupancy restrooms, showers, | |
18 | 18 | or changing facilities. | |
19 | 19 | (b) Subsection (a) may be enforced only through an action | |
20 | 20 | instituted by the attorney general for mandamus or injunctive | |
21 | 21 | relief. The attorney general may recover costs and attorney's fees | |
22 | 22 | related to enforcing Subsection (a). | |
23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect 91 days after the last day of the legislative | |
28 | 28 | session. |
