66 AN ACT
77 relating to the receipt by certain relative caretakers of dependent
88 children of supplemental financial assistance and the assignment of
99 those relative caretakers as protective payees for financial
1010 assistance payments; providing a civil penalty; creating a criminal
1111 offense.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 31.0041(a), Human Resources Code, is
1414 amended to read as follows:
1515 (a) To the extent funds are appropriated for this purpose,
1616 the commission may provide supplemental financial assistance in
1717 addition to the amount of financial assistance granted for the
1818 support of a dependent child under Section 31.003 to a person who:
1919 (1) is 25 [45] years of age or older;
2020 (2) is the grandparent, aunt, uncle, sister, or
2121 brother of the dependent child, as defined by Section 31.002, who
2222 lives at the person's residence;
2323 (3) is the primary caretaker of the dependent child;
2424 (4) has a family income that is at or below 200 percent
2525 of the federal poverty level; and
2626 (5) does not have resources that exceed the amount
2727 allowed for financial assistance under this chapter.
2828 SECTION 2. Subchapter A, Chapter 31, Human Resources Code,
2929 is amended by adding Section 31.0042 to read as follows:
3030 Sec. 31.0042. FRAUDULENT RECEIPT OF CERTAIN ASSISTANCE;
3131 CRIMINAL OFFENSE; CIVIL PENALTY. (a) A person commits an offense
3232 if, with intent to defraud or deceive the commission, the person
3333 knowingly makes or causes to be made a false statement or
3434 misrepresentation of a material fact that allows a person to
3535 receive supplemental financial assistance under Section 31.0041.
3636 (b) An offense under Subsection (a) is a state jail felony
3737 unless it is shown on the trial of the offense that the person has
3838 previously been convicted under this section, in which case the
3939 offense is a felony of the third degree.
4040 (c) If conduct that constitutes an offense under this
4141 section also constitutes an offense under any other law, the actor
4242 may be prosecuted under this section, the other law, or both.
4343 (d) The appropriate county prosecuting attorney is
4444 responsible for the prosecution of an offense under this section.
4545 (e) A person who engaged in conduct described by Subsection
4646 (a) is liable to the state for a civil penalty of $1,000. The
4747 attorney general shall bring an action to recover the civil penalty
4848 authorized by this subsection.
4949 (f) The executive commissioner may adopt rules necessary to
5050 determine whether fraudulent activity that violates Subsection (a)
5151 has occurred.
5252 SECTION 3. Section 31.0324, Human Resources Code, is
5353 amended by amending Subsections (b) and (c) and adding Subsection
5454 (d) to read as follows:
5555 (b) The executive commissioner by rule shall develop and the
5656 commission shall implement a process that provides for the
5757 grandparent, aunt, uncle, sister, or brother of a child receiving
5858 financial assistance under this chapter to serve as a protective
5959 payee to:
6060 (1) receive and use the assistance on behalf of the
6161 child; and
6262 (2) apply for financial assistance and be interviewed
6363 instead of the child's parent at any subsequent review of
6464 eligibility required by the commission.
6565 (c) The commission shall limit the use of the process
6666 established by Subsection (b) to situations in which the commission
6767 determines the parent is not using the assistance for the child's
6868 needs as required by Section 31.0355(a), and the executive
6969 commissioner shall establish by rule the circumstances under which
7070 the grandparent, aunt, uncle, sister, or brother may be removed as a
7171 protective payee.
7272 (d) To serve as a protective payee of a child receiving
7373 financial assistance under this chapter, a person described by
7474 Subsection (b) must be at least 25 years of age.
7575 SECTION 4. The changes in law made by this Act apply to a
7676 person receiving financial assistance under Chapter 31, Human
7777 Resources Code, on or after the effective date of this Act,
7878 regardless of the date on which eligibility for the financial
7979 assistance was determined.
8080 SECTION 5. If before implementing any provision of this Act
8181 a state agency determines that a waiver or authorization from a
8282 federal agency is necessary for implementation of that provision,
8383 the agency affected by the provision shall request the waiver or
8484 authorization and may delay implementing that provision until the
8585 waiver or authorization is granted.
8686 SECTION 6. This Act takes effect December 1, 2017.
