66 AN ACT
77 relating to prohibited acts for a physician or applicant for a
88 medical license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 164.052(a), Occupations Code, as
1111 effective September 1, 2017, is amended to read as follows:
1212 (a) A physician or an applicant for a license to practice
1313 medicine commits a prohibited practice if that person:
1414 (1) submits to the board a false or misleading
1515 statement, document, or certificate in an application for a
1616 license;
1717 (2) presents to the board a license, certificate, or
1818 diploma that was illegally or fraudulently obtained;
1919 (3) commits fraud or deception in taking or passing an
2020 examination;
2121 (4) uses alcohol or drugs in an intemperate manner
2222 that, in the board's opinion, could endanger a patient's life;
2323 (5) commits unprofessional or dishonorable conduct
2424 that is likely to deceive or defraud the public, as provided by
2525 Section 164.053, or injure the public;
2626 (6) uses an advertising statement that is false,
2727 misleading, or deceptive;
2828 (7) advertises professional superiority or the
2929 performance of professional service in a superior manner if that
3030 advertising is not readily subject to verification;
3131 (8) purchases, sells, barters, or uses, or offers to
3232 purchase, sell, barter, or use, a medical degree, license,
3333 certificate, or diploma, or a transcript of a license, certificate,
3434 or diploma in or incident to an application to the board for a
3535 license to practice medicine;
3636 (9) alters, with fraudulent intent, a medical license,
3737 certificate, or diploma, or a transcript of a medical license,
3838 certificate, or diploma;
3939 (10) uses a medical license, certificate, or diploma,
4040 or a transcript of a medical license, certificate, or diploma that
4141 has been:
4242 (A) fraudulently purchased or issued;
4343 (B) counterfeited; or
4444 (C) materially altered;
4545 (11) impersonates or acts as proxy for another person
4646 in an examination required by this subtitle for a medical license;
4747 (12) engages in conduct that subverts or attempts to
4848 subvert an examination process required by this subtitle for a
4949 medical license;
5050 (13) impersonates a physician or permits another to
5151 use the person's license or certificate to practice medicine in
5252 this state;
5353 (14) directly or indirectly employs a person whose
5454 license to practice medicine has been suspended, canceled, or
5555 revoked;
5656 (15) associates in the practice of medicine with a
5757 person:
5858 (A) whose license to practice medicine has been
5959 suspended, canceled, or revoked; or
6060 (B) who has been convicted of the unlawful
6161 practice of medicine in this state or elsewhere;
6262 (16) performs or procures a criminal abortion, aids or
6363 abets in the procuring of a criminal abortion, attempts to perform
6464 or procure a criminal abortion, or attempts to aid or abet the
6565 performance or procurement of a criminal abortion;
6666 (17) directly or indirectly aids or abets the practice
6767 of medicine by a person, partnership, association, or corporation
6868 that is not licensed to practice medicine by the board;
6969 (18) performs an abortion on a woman who is pregnant
7070 with a viable unborn child during the third trimester of the
7171 pregnancy unless:
7272 (A) the abortion is necessary to prevent the
7373 death of the woman;
7474 (B) the viable unborn child has a severe,
7575 irreversible brain impairment; or
7676 (C) the woman is diagnosed with a significant
7777 likelihood of suffering imminent severe, irreversible brain damage
7878 or imminent severe, irreversible paralysis;
7979 (19) performs an abortion on an unemancipated minor
8080 without the written consent of the child's parent, managing
8181 conservator, or legal guardian or without a court order, as
8282 provided by Section 33.003 or 33.004, Family Code, unless the
8383 abortion is necessary due to a medical emergency, as defined by
8484 Section 171.002, Health and Safety Code;
8585 (20) otherwise performs an abortion on an
8686 unemancipated minor in violation of Chapter 33, Family Code; [or]
8787 (21) performs or induces or attempts to perform or
8888 induce an abortion in violation of Subchapter C, F, or G, Chapter
8989 171, Health and Safety Code; or
9090 (22) notwithstanding Subdivisions (18)-(21) or any
9191 other law, performs an abortion on a woman unless:
9292 (A) there exists a condition that, in a
9393 physician's reasonable medical judgment, so complicates the
9494 medical condition of the woman that, to avert the woman's death or a
9595 serious risk of substantial and irreversible physical impairment of
9696 a major bodily function, other than a psychological condition, it
9797 necessitates the abortion; or
9898 (B) if the woman is pregnant with multiple unborn
9999 children, the abortion is necessary to ensure that at least one
100100 unborn child is born alive and healthy.
101101 SECTION 2. Section 164.055, Occupations Code, as effective
102102 September 1, 2017, is amended to read as follows:
103103 Sec. 164.055. PROHIBITED ACTS REGARDING ABORTION. (a) The
104104 board shall take an appropriate disciplinary action against a
105105 physician who violates Section 170.002 or Chapter 171, Health and
106106 Safety Code, and shall revoke the license of a physician who
107107 violates Section 164.052(a)(22) of this code. The board shall
108108 refuse to admit to examination or refuse to issue a license or
109109 renewal license to a person who violates any of those provisions
110110 [that section or chapter].
111111 (b) The sanctions provided by Subsection (a) are in addition
112112 to any other grounds for refusal to admit persons to examination
113113 under this subtitle or to issue a license or renew a license to
114114 practice medicine under this subtitle. The criminal penalties
115115 provided by Section 165.152 do not apply to a violation of Section
116116 170.002, Health and Safety Code, [or] Subchapter C, F, or G, Chapter
117117 171, Health and Safety Code, or Section 164.052(a)(22) of this
118118 code.
119119 SECTION 3. Sections 164.052 and 164.055, Occupations Code,
120120 as amended by this Act, apply only to an abortion performed on or
121121 after the effective date of this Act. An abortion performed before
122122 the effective date of this Act is governed by the law applicable to
123123 the abortion on the date the abortion is performed, and that law is
124124 continued in effect for that purpose.
125125 SECTION 4. This Act takes effect on the 91st day after the
126126 last day of the legislative session.
