55 CONCURRENT RESOLUTION
66 WHEREAS, In May 2007, Beneficial Land Management was
77 authorized to use wastewater treatment plant sewage sludge to
88 condition or fertilize soil in Victoria County; and
99 WHEREAS, BLM runs Partners Dewatering International, which
1010 operates the City of LaCoste wastewater treatment plant; while the
1111 Texas Commission on Environmental Quality granted the plant
1212 approval to process grease trap waste and grit trap waste, land
1313 application of the waste was not approved; and
1414 WHEREAS, BLM violated the existing land application permit by
1515 applying grease and grit trap waste from LaCoste to land in Victoria
1616 County; when the TCEQ recognized this infraction, BLM was notified,
1717 and the commission and the company entered into a compliance
1818 agreement with required monitoring and sampling of the application
1919 site, allowing BLM to continue its land application operations
2020 until July 6, 2014; and
2121 WHEREAS, The company has since applied for another
2222 experimental use permit to allow for the land application of grease
2323 and grit trap waste, and this has become the focus of a contested
2424 case at the State Office of Administrative Hearings; and
2525 WHEREAS, The land application of grease and grit trap waste
2626 presents a significant threat of damage to Arenosa Creek, Lavaca
2727 Bay, and the surrounding land resources in Victoria County and
2828 beyond, and it is incumbent on the Texas Commission on
2929 Environmental Quality to continue to oppose requests to do so; now,
3030 therefore, be it
3131 RESOLVED, That the 85th Legislature of the State of Texas,
3232 1st Called Session, hereby direct the Texas Commission on
3333 Environmental Quality to maintain its opposition to the Beneficial
3434 Land Management request to land apply grease and grit trap waste and
3535 to actively oppose any efforts to circumvent existing state law by
3636 land applying grease and grit trap waste; and, be it further
3737 RESOLVED, That the Texas secretary of state forward official
3838 copies of this resolution to the offices of the commissioners and
3939 the executive director of the Texas Commission on Environmental
4040 Quality.
