| 6 | 6 | | WHEREAS, In May 2007, Beneficial Land Management was |
|---|
| 7 | 7 | | authorized to use wastewater treatment plant sewage sludge to |
|---|
| 8 | 8 | | condition or fertilize soil in Victoria County; and |
|---|
| 9 | 9 | | WHEREAS, BLM runs Partners Dewatering International, which |
|---|
| 10 | 10 | | operates the City of LaCoste wastewater treatment plant; while the |
|---|
| 11 | 11 | | Texas Commission on Environmental Quality granted the plant |
|---|
| 12 | 12 | | approval to process grease trap waste and grit trap waste, land |
|---|
| 13 | 13 | | application of the waste was not approved; and |
|---|
| 14 | 14 | | WHEREAS, BLM violated the existing land application permit by |
|---|
| 15 | 15 | | applying grease and grit trap waste from LaCoste to land in Victoria |
|---|
| 16 | 16 | | County; when the TCEQ recognized this infraction, BLM was notified, |
|---|
| 17 | 17 | | and the commission and the company entered into a compliance |
|---|
| 18 | 18 | | agreement with required monitoring and sampling of the application |
|---|
| 19 | 19 | | site, allowing BLM to continue its land application operations |
|---|
| 20 | 20 | | until July 6, 2014; and |
|---|
| 21 | 21 | | WHEREAS, The company has since applied for another |
|---|
| 22 | 22 | | experimental use permit to allow for the land application of grease |
|---|
| 23 | 23 | | and grit trap waste, and this has become the focus of a contested |
|---|
| 24 | 24 | | case at the State Office of Administrative Hearings; and |
|---|
| 25 | 25 | | WHEREAS, The land application of grease and grit trap waste |
|---|
| 26 | 26 | | presents a significant threat of damage to Arenosa Creek, Lavaca |
|---|
| 27 | 27 | | Bay, and the surrounding land resources in Victoria County and |
|---|
| 28 | 28 | | beyond, and it is incumbent on the Texas Commission on |
|---|
| 29 | 29 | | Environmental Quality to continue to oppose requests to do so; now, |
|---|
| 30 | 30 | | therefore, be it |
|---|
| 31 | 31 | | RESOLVED, That the 85th Legislature of the State of Texas, |
|---|
| 32 | 32 | | 1st Called Session, hereby direct the Texas Commission on |
|---|
| 33 | 33 | | Environmental Quality to maintain its opposition to the Beneficial |
|---|
| 34 | 34 | | Land Management request to land apply grease and grit trap waste and |
|---|
| 35 | 35 | | to actively oppose any efforts to circumvent existing state law by |
|---|
| 36 | 36 | | land applying grease and grit trap waste; and, be it further |
|---|
| 37 | 37 | | RESOLVED, That the Texas secretary of state forward official |
|---|
| 38 | 38 | | copies of this resolution to the offices of the commissioners and |
|---|
| 39 | 39 | | the executive director of the Texas Commission on Environmental |
|---|
| 40 | 40 | | Quality. |
