108 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11- SECTION 1. Section 22, Article VIII, Texas Constitution, is
12- amended to read as follows:
13- Sec. 22. (a) The rate of growth of appropriations from all
14- sources of state revenue other than the federal government may not
15- in any [In no] biennium exceed the estimated [shall the] rate of
16- growth in this state's population during the biennium for which
17- appropriations are made, adjusted by the estimated rate of
18- inflation in this state during the same period [of appropriations
9+ SECTION 1. Sections 22(a) and (b), Article VIII, Texas
10+ Constitution, are amended to read as follows:
11+ (a) The rate of growth of appropriations from all sources of
12+ state revenue other than the federal government for each category
13+ of state spending identified by this subsection may not in any [In
14+ no] biennium exceed the estimated [shall the] rate of growth in the
15+ population served by expenditures in that spending category,
16+ adjusted by the estimated rate of inflation in a representative set
17+ of goods and services for which appropriations are made for that
18+ spending category. The categories of state spending to which this
19+ subsection applies are transportation, public primary and
20+ secondary education, higher education, health care, public safety
21+ and corrections, and other general government [of appropriations
1922 from state tax revenues not dedicated by this constitution exceed
2023 the estimated rate of growth of the state's economy]. The
21- legislature by general law shall provide [by general law]
22- procedures to implement this subsection.

2327 (b) If the legislature by adoption of a resolution approved

27- excess of the amount authorized by Subsection (a) of this section.
28- The excess amount authorized under this subsection may not exceed
29- the amount specified in the resolution.
30- (c) In no case shall appropriations exceed revenues as
31- provided in Section 49a, Article III, [Section 49a,] of this
32- constitution. Nothing in this section shall be construed to alter,
33- amend, or repeal Section 49a, Article III, [Section 49a,] of this
34- constitution.

3535 SECTION 2. The following temporary provision is added to
3636 the Texas Constitution:
3737 TEMPORARY PROVISION. (a) This temporary provision applies
3838 to the constitutional amendment proposed by the 85th Legislature,
3939 1st Called Session, 2017, regarding the limitation on the rate of
4040 growth of appropriations.
4141 (b) The amendments to Section 22, Article VIII, of this
4242 constitution apply only in relation to appropriations made for the
4343 state fiscal biennium beginning September 1, 2019, and subsequent
4444 state fiscal bienniums.
4545 (c) This temporary provision expires January 1, 2020.
4646 SECTION 3. This proposed constitutional amendment shall be
4747 submitted to the voters at an election to be held November 7, 2017.
4848 The ballot shall be printed to permit voting for or against the
4949 proposition: "The constitutional amendment regarding the
5050 limitation on the rate of growth of appropriations."
