55 A JOINT RESOLUTION
66 proposing a constitutional amendment to authorize the legislature
77 to limit increases in the appraised value of commercial or
88 industrial real property for ad valorem tax purposes.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1, Article VIII, Texas Constitution, is
1111 amended by adding Subsection (k) to read as follows:
1212 (k) Notwithstanding Subsections (a) and (b) of this
1313 section, the Legislature by general law may limit the maximum
1414 appraised value of a parcel of commercial or industrial real
1515 property, as defined by the Legislature, for ad valorem tax
1616 purposes in a tax year to the lesser of the most recent market value
1717 of the property as determined by the appraisal entity or 120
1818 percent, or a greater percentage, of the appraised value of the
1919 property for the preceding tax year. A limitation on appraised
2020 values authorized by this subsection:
2121 (1) takes effect as to a parcel of commercial or
2222 industrial real property on the later of the effective date of the
2323 law imposing the limitation or January 1 of the tax year following
2424 the first tax year in which the owner owns the property on January 1
2525 and in which the property qualifies as commercial or industrial
2626 real property; and
2727 (2) expires on January 1 of the tax year following the
2828 first tax year in which the owner of the property ceases to own the
2929 property or the property ceases to qualify as commercial or
3030 industrial real property.
3131 SECTION 2. This proposed constitutional amendment shall be
3232 submitted to the voters at an election to be held November 7, 2017.
3333 The ballot shall be printed to permit voting for or against the
3434 proposition: "The constitutional amendment to authorize the
3535 legislature to limit increases in the appraised value of commercial
3636 or industrial real property for ad valorem tax purposes to 20
3737 percent or more of the appraised value of the property for the
3838 preceding tax year."
