55 A JOINT RESOLUTION
66 proposing a constitutional amendment requiring a political
77 subdivision of this state to limit the number of terms for which a
88 person may be elected to hold an office of the political
99 subdivision.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article XVI, Texas Constitution, is amended by
1212 adding Section 30c to read as follows:
1313 Sec. 30c. (a) The legislature by general law shall require
1414 a political subdivision of this state that is governed by one or
1515 more elected officers to establish a limit on the number of terms a
1616 person may be elected to serve in an office of the political
1717 subdivision to ensure that a person may not serve longer than 12
1818 years in an office.
1919 (b) An officer who has been elected to serve for the maximum
2020 number of terms established by the political subdivision as
2121 required by Subsection (a) of this section is not eligible for
2222 election to serve an additional term of that office.
2323 SECTION 2. The following temporary provision is added to
2424 the Texas Constitution:
2525 TEMPORARY PROVISION. (a) This temporary provision applies
2626 to the constitutional amendment proposed by the 85th Legislature,
2727 1st Called Session, 2017, requiring a political subdivision of this
2828 state to limit the number of terms for which a person may be elected
2929 to hold an office of the political subdivision.
3030 (b) A term that begins before January 1, 2020, is not
3131 counted in determining whether a person is eligible to serve under
3232 Section 30c, Article XVI, of this constitution.
3333 (c) This temporary provision expires February 1, 2036.
3434 SECTION 3. This proposed constitutional amendment shall be
3535 submitted to the voters at an election to be held November 6, 2018.
3636 The ballot shall be printed to permit voting for or against the
3737 proposition: "The constitutional amendment requiring a political
3838 subdivision to limit the number of terms of its officers so that a
3939 person may not hold an elected office of the political subdivision
4040 for longer than 12 years."
