55 A JOINT RESOLUTION
66 proposing a constitutional amendment limiting to two the number of
77 consecutive terms for which a person may be elected or appointed to
88 hold certain state offices.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article IV, Texas Constitution, is amended by
1111 adding Section 2a to read as follows:
1212 Sec. 2a. (a) A person who has been elected or appointed to
1313 serve two consecutive terms in an office listed in Section 1 of this
1414 article or any other office of state government that is voted on
1515 statewide, other than a statewide judicial office, is not eligible
1616 for election or appointment to serve a third consecutive term in
1717 that office. This provision does not limit a person's eligibility
1818 for election or appointment to serve nonconsecutive terms.
1919 (b) Nothing in this section prohibits a person from
2020 continuing to serve in an office covered by this section after the
2121 end of a term as a holdover under Section 17, Article XVI, of this
2222 constitution until a successor is qualified.
2323 (c) The term of a person appointed to serve for the
2424 remainder of a term to fill a vacancy in a statewide office is not
2525 counted in determining whether a person is eligible to serve under
2626 Subsection (a) of this section.
2727 SECTION 2. The following temporary provision is added to
2828 the Texas Constitution:
2929 TEMPORARY PROVISION. (a) This temporary provision applies
3030 to the constitutional amendment proposed by the 85th Legislature,
3131 1st Called Session, 2017, limiting to two the number of consecutive
3232 terms for which a person may be elected or appointed to hold certain
3333 state offices.
3434 (b) A term of office that begins before January 1, 2018, is
3535 not counted in determining whether a person is eligible to serve
3636 under Section 2a, Article IV, of this constitution.
3737 (c) This temporary provision expires February 1, 2035.
3838 SECTION 3. This proposed constitutional amendment shall be
3939 submitted to the voters at an election to be held November 7, 2017.
4040 The ballot shall be printed to permit voting for or against the
4141 proposition: "The constitutional amendment limiting to two the
4242 number of consecutive terms for which a person may be elected or
4343 appointed to hold the office of governor, lieutenant governor,
4444 secretary of state, comptroller of public accounts, commissioner of
4545 the General Land Office, attorney general, commissioner of
4646 agriculture, or railroad commissioner."
