55 A JOINT RESOLUTION
66 proposing a constitutional amendment providing for certain excess
77 revenue to be dedicated toward contributions to the state
88 retirement system for education employees and to the health benefit
99 plan for retired education employees and their dependents.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 49-g, Article III, Texas Constitution,
1212 is amended by adding Subsections (p) and (q) to read as follows:
1313 (p) When the comptroller acts to prevent the amount in the
1414 economic stabilization fund from exceeding the limit in effect for
1515 a biennium under Subsection (g) of this section by reducing an
1616 amount transferred to the fund from general revenue as provided by
1717 Subsection (b) or (c) of this section or by crediting to general
1818 revenue interest due to the economic stabilization fund as provided
1919 by Subsection (i) of this section, the comptroller shall credit to
2020 an account in the general revenue fund in the state treasury:
2121 (1) if the comptroller reduces the amount transferred
2222 under Subsection (b) of this section, an amount of general revenue
2323 equal to the difference between the amount transferred to the
2424 economic stabilization fund under Subsection (b) of this section
2525 and the amount that would have been transferred under that
2626 subsection but for the limit in effect under Subsection (g) of this
2727 section;
2828 (2) if the comptroller reduces the amount transferred
2929 under Subsection (c) of this section, an amount of general revenue
3030 equal to the difference between the amount transferred to the
3131 economic stabilization fund under Subsection (c) of this section
3232 and the amount that would have been transferred under that
3333 subsection but for the limit in effect under Subsection (g) of this
3434 section; and
3535 (3) if the comptroller reduces the amount credited to
3636 the economic stabilization fund under Subsection (i) of this
3737 section, an amount of general revenue equal to the amount credited
3838 to general revenue under that subsection.
3939 (q) General revenue credited to the account in the general
4040 revenue fund in the state treasury as provided by Subsection (p) of
4141 this section, and the interest or other earnings on the balance of
4242 that account, may be appropriated only for the purpose of making an
4343 additional contribution to the Teacher Retirement System of Texas
4444 created under Section 67(b), Article XVI, of this constitution, or
4545 to the health benefit plan created for the retired members of the
4646 Teacher Retirement System of Texas and their dependents.
4747 SECTION 2. This proposed constitutional amendment shall be
4848 submitted to the voters at an election to be held November 7, 2017.
4949 The ballot shall be printed to provide for voting for or against the
5050 proposition: "The constitutional amendment providing for certain
5151 excess revenue to be dedicated toward contributions to the state
5252 retirement system for education employees and to the health benefit
5353 plan for retired education employees and their dependents."
