44 R E S O L U T I O N
55 BE IT RESOLVED by the House of Representatives of the State of
66 Texas, that the following amendments to the permanent rules of the
77 House of Representatives of the 85th Legislature are hereby
88 adopted.
99 Rule 5, Sec. 6 is amended to read as follows:
1010 Sec. 6. MOTIONS IN ORDER WHEN QUORUM NOT PRESENT. If a
1111 registration or record vote reveals that a quorum is not present,
1212 only a motion to adjourn or a motion for a call of the house and the
1313 motions incidental thereto, including motions to impose penalties
1414 on absent members, shall be in order.
1515 Rule 5, Sec. 8 is amended to read as follows:
1616 Sec. 8. SECURING A QUORUM. When a call of the house is moved
1717 for one of the above purposes and seconded by 15 members (of whom
1818 the speaker may be one) and ordered by a majority vote, the main
1919 entrance to the hall and all other doors leading out of the hall
2020 shall be locked and no member permitted to leave the house without
2121 the written permission of the speaker. The names of members present
2222 shall be recorded. All absentees for whom no sufficient excuse is
2323 made may, by order of a majority of those present, be sent for and
2424 arrested, wherever they may be found, by the sergeant-at-arms or an
2525 officer appointed by the sergeant-at-arms for that purpose, and
2626 their attendance shall be secured and retained. The house shall
2727 determine on what conditions they shall be discharged. Members who
2828 voluntarily appear shall, unless the house otherwise directs, be
2929 immediately admitted to the hall of the house and shall report their
3030 names to the clerk to be entered in the journal as present.
3131 Until a quorum appears, should the roll call fail to show one
3232 present, it shall not be in order to recess under a call of the house
3333 and no business shall be transacted, except to adjourn, to compel
3434 the attendance of absent members, or, by a vote of a majority of all
3535 members, impose the following penalties on absent members:
3636 (1) remove an absent member from any committee
3737 chairmanship;
3838 (2) remove an absent member from any procedural
3939 committee; and
4040 (3) permanently remove any privilege or advantage
4141 regularly due to an absent member on the basis of seniority [or to
4242 adjourn. It shall not be in order to recess under a call of the
4343 house].
