66 AN ACT
77 relating to an opportunity to correct a defect in an early voting
88 ballot voted by mail and to the use of an application for an early
99 voting ballot to change a voter's registration address within the
1010 county.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 84.011, Election Code, is amended by
1313 adding Subsection (c) to read as follows:
1414 (c) In addition to the requirements imposed by Subsection
1515 (a), the officially prescribed application form for an early voting
1616 ballot must include a space for the voter to provide a change of
1717 residence address within the county, if applicable.
1818 SECTION 2. Section 84.032(c), Election Code, is amended to
1919 read as follows:
2020 (c) An applicant may submit a request after the close of
2121 early voting by personal appearance by appearing in person and:
2222 (1) returning the ballot to be voted by mail to the
2323 early voting clerk; or
2424 (2) executing an affidavit that the applicant:
2525 (A) has not received the ballot to be voted by
2626 mail; or
2727 (B) received notice of a defect under Section
2828 87.0271(b) or 87.0411(b).
2929 SECTION 3. Section 86.001, Election Code, is amended by
3030 adding Subsection (f) to read as follows:
3131 (f) If the application includes a change of address within
3232 the county, the early voting clerk shall notify the voter registrar
3333 of the change and the registrar shall update the voter's
3434 registration accordingly.
3535 SECTION 4. Section 86.002, Election Code, is amended by
3636 adding Subsection (a-1) to read as follows:
3737 (a-1) Notwithstanding Subsection (a), the clerk is not
3838 required to provide a form for a statement of residence to a voter
3939 who indicated a change of address within the county on the voter's
4040 application for an early voting ballot to be voted by mail.
4141 SECTION 5. Subchapter B, Chapter 87, Election Code, is
4242 amended by adding Section 87.0271 to read as follows:
4343 Sec. 87.0271. OPPORTUNITY TO CORRECT DEFECT: SIGNATURE
4444 VERIFICATION COMMITTEE. (a) This section applies to an early
4545 voting ballot voted by mail:
4646 (1) for which the voter did not sign the carrier
4747 envelope certificate;
4848 (2) for which it cannot immediately be determined
4949 whether the signature on the carrier envelope certificate is that
5050 of the voter;
5151 (3) missing any required statement of residence; or
5252 (4) containing incomplete information with respect to
5353 a witness.
5454 (b) Before deciding whether to accept or reject a timely
5555 delivered ballot under Section 87.027, the signature verification
5656 committee may:
5757 (1) return the carrier envelope to the voter by mail,
5858 if the signature verification committee determines that it would be
5959 possible to correct the defect and return the carrier envelope
6060 before the time the polls are required to close on election day; or
6161 (2) notify the voter of the defect by telephone or
6262 e-mail and inform the voter that the voter may come to the early
6363 voting clerk's office in person to:
6464 (A) correct the defect; or
6565 (B) request to have the voter's application to
6666 vote by mail canceled under Section 84.032.
6767 (c) If the signature verification committee takes an action
6868 described by Subsection (b), the committee must take either action
6969 described by that subsection with respect to each ballot in the
7070 election to which this section applies.
7171 (d) A poll watcher is entitled to observe an action taken
7272 under Subsection (b).
7373 (e) The secretary of state may prescribe any procedures
7474 necessary to implement this section.
7575 SECTION 6. Subchapter C, Chapter 87, Election Code, is
7676 amended by adding Section 87.0411 to read as follows:
7777 Sec. 87.0411. OPPORTUNITY TO CORRECT DEFECT: EARLY VOTING
7878 BALLOT BOARD. (a) This section applies to an early voting ballot
7979 voted by mail:
8080 (1) for which the voter did not sign the carrier
8181 envelope certificate;
8282 (2) for which it cannot immediately be determined
8383 whether the signature on the carrier envelope certificate is that
8484 of the voter;
8585 (3) missing any required statement of residence; or
8686 (4) containing incomplete information with respect to
8787 a witness.
8888 (b) Before deciding whether to accept or reject a timely
8989 delivered ballot under Section 87.041, the early voting ballot
9090 board may:
9191 (1) return the carrier envelope to the voter by mail,
9292 if the early voting ballot board determines that it would be
9393 possible to correct the defect and return the carrier envelope
9494 before the time the polls are required to close on election day; or
9595 (2) notify the voter of the defect by telephone or
9696 e-mail and inform the voter that the voter may come to the early
9797 voting clerk's office in person to:
9898 (A) correct the defect; or
9999 (B) request to have the voter's application to
100100 vote by mail canceled under Section 84.032.
101101 (c) If the early voting ballot board takes an action
102102 described by Subsection (b), the board must take either action
103103 described by that subsection with respect to each ballot in the
104104 election to which this section applies.
105105 (d) A poll watcher is entitled to observe an action taken
106106 under Subsection (b).
107107 (e) The secretary of state may prescribe any procedures
108108 necessary to implement this section.
109109 SECTION 7. This Act takes effect December 1, 2017.
