| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter E, Chapter 42, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 42.25162 to read as follows: |
|---|
| 12 | 12 | | Sec. 42.25162. ADDITIONAL STATE AID FOR CERTAIN COMMON |
|---|
| 13 | 13 | | SCHOOL DISTRICTS. (a) This section applies only to a common school |
|---|
| 14 | 14 | | district that received for the 2016-2017 or a preceding school year |
|---|
| 15 | 15 | | additional state aid under Section 42.2516. |
|---|
| 16 | 16 | | (b) A common school district to which this section applies |
|---|
| 17 | 17 | | is entitled to the additional state aid that would have been |
|---|
| 18 | 18 | | provided to the district for the current school year under Section |
|---|
| 19 | 19 | | 42.2516, as that section existed on January 1, 2017, if the district |
|---|
| 20 | 20 | | demonstrates, to the satisfaction of the commissioner, that the |
|---|
| 21 | 21 | | failure to receive that state aid would require the district to |
|---|
| 22 | 22 | | close at least one campus. |
|---|
| 23 | 23 | | (c) The commissioner shall adopt rules necessary to |
|---|
| 24 | 24 | | implement this section. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2017, if it |
|---|
| 26 | 26 | | receives a vote of two-thirds of all the members elected to each |
|---|
| 27 | 27 | | house, as provided by Section 39, Article III, Texas Constitution. |
|---|
| 28 | 28 | | If this Act does not receive the vote necessary for effect on that |
|---|
| 29 | 29 | | date, this Act takes effect on the 91st day after the last day of the |
|---|
| 30 | 30 | | legislative session. |
