| 7 | 7 | | relating to additional state aid for certain school districts. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter E, Chapter 42, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 42.25162 to read as follows: |
|---|
| 11 | 11 | | Sec. 42.25162. ADDITIONAL STATE AID FOR CERTAIN DISTRICTS. |
|---|
| 12 | 12 | | (a) This section applies only to a school district determined by |
|---|
| 13 | 13 | | the commissioner to be the predominant provider of public education |
|---|
| 14 | 14 | | in a county of this state based on the following factors: |
|---|
| 15 | 15 | | (1) the extent to which the district is the public |
|---|
| 16 | 16 | | education provider for substantially all of the students residing |
|---|
| 17 | 17 | | in the county who attend school in a school district, other than a |
|---|
| 18 | 18 | | minimal number of students in the county who reside in the |
|---|
| 19 | 19 | | attendance zone of another school district; |
|---|
| 20 | 20 | | (2) the degree of hardship that the district's |
|---|
| 21 | 21 | | students would experience if the district were to discontinue |
|---|
| 22 | 22 | | providing public education and the district's students were |
|---|
| 23 | 23 | | required to attend school in another school district; and |
|---|
| 24 | 24 | | (3) any other relevant factor identified by the |
|---|
| 25 | 25 | | commissioner. |
|---|
| 26 | 26 | | (b) A school district is entitled to the additional state |
|---|
| 27 | 27 | | aid that would have been provided to the district for the current |
|---|
| 28 | 28 | | school year under Section 42.2516, as that section existed on |
|---|
| 29 | 29 | | January 1, 2017, if the district demonstrates, to the satisfaction |
|---|
| 30 | 30 | | of the commissioner, that the failure to receive that state aid |
|---|
| 31 | 31 | | would require the district to close at least one campus. |
|---|
| 32 | 32 | | (c) The commissioner shall adopt rules necessary to |
|---|
| 33 | 33 | | implement this section. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2017, if it |
|---|
| 35 | 35 | | receives a vote of two-thirds of all the members elected to each |
|---|
| 36 | 36 | | house, as provided by Section 39, Article III, Texas Constitution. |
|---|
| 37 | 37 | | If this Act does not receive the vote necessary for effect on that |
|---|
| 38 | 38 | | date, this Act takes effect on the 91st day after the last day of the |
|---|
| 39 | 39 | | legislative session. |
