55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to additional state aid for certain school districts.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter E, Chapter 42, Education Code, is
1010 amended by adding Section 42.25162 to read as follows:
1111 Sec. 42.25162. ADDITIONAL STATE AID FOR CERTAIN DISTRICTS.
1212 (a) This section applies only to a school district determined by
1313 the commissioner to be the predominant provider of public education
1414 in a county of this state based on the following factors:
1515 (1) the extent to which the district is the public
1616 education provider for substantially all of the students residing
1717 in the county who attend school in a school district, other than a
1818 minimal number of students in the county who reside in the
1919 attendance zone of another school district;
2020 (2) the degree of hardship that the district's
2121 students would experience if the district were to discontinue
2222 providing public education and the district's students were
2323 required to attend school in another school district; and
2424 (3) any other relevant factor identified by the
2525 commissioner.
2626 (b) A school district is entitled to the additional state
2727 aid that would have been provided to the district for the current
2828 school year under Section 42.2516, as that section existed on
2929 January 1, 2017, if:
3030 (1) the district demonstrates, to the satisfaction of
3131 the commissioner, that the failure to receive that state aid would
3232 require the district to close at least one campus; and
3333 (2) the district received additional state aid under
3434 Section 42.2516, for:
3535 (A) the 2015-2016 school year; or
3636 (B) the 2016-2017 school year.
3737 (c) In implementing this section, the commissioner shall
3838 make determinations regarding additional state aid under Section
3939 42.2516, as that section existed January 1, 2017, using the
4040 percentage reduction for purposes of former Section 42.2516(i)
4141 specified by appropriation for the 2016-2017 school year.
4242 (d) Notwithstanding any other provision of law, including
4343 Section 42.2528, if the commissioner determines that the amount
4444 appropriated for the purposes of the Foundation School Program
4545 exceeds the amount to which school districts are entitled under
4646 this chapter, the commissioner by rule shall use the excess funds to
4747 provide funding to school districts entitled to funds under this
4848 section.
4949 (e) The commissioner shall adopt rules necessary to
5050 implement this section.
5151 SECTION 2. Section 42.2528(a), Education Code, is amended
5252 to read as follows:
5353 (a) Except as provided by Section 42.25162, notwithstanding
5454 [Notwithstanding] any other provision of law, if the commissioner
5555 determines that the amount appropriated for the purposes of the
5656 Foundation School Program exceeds the amount to which school
5757 districts are entitled under this chapter, the commissioner by rule
5858 shall establish a grant program through which excess funds are
5959 awarded as grants for the purchase of video equipment, or for the
6060 reimbursement of costs for previously purchased video equipment,
6161 used for monitoring special education classrooms or other special
6262 education settings required under Section 29.022.
6363 SECTION 3. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect on the 91st day after the last day of the
6868 legislative session.
