44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the punishment for certain voting-related offenses
77 committed or attempted by persons who are not citizens of the United
88 States.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 13.007(b), Election Code, is amended to
1111 read as follows:
1212 (b) An offense under this section is a Class B misdemeanor,
1313 unless the person is not a citizen of the United States. In that
1414 case, the offense is a state jail felony.
1515 SECTION 2. Section 64.012, Election Code, is amended by
1616 amending Subsection (b) and adding Subsection (c) to read as
1717 follows:
1818 (b) Except as provided by Subsection (c), an [An] offense
1919 under this section is a felony of the second degree [unless the
2020 person is convicted of an attempt. In that case, the offense is a
2121 state jail felony].
2222 (c) If a person is convicted of an attempt to commit an
2323 offense under this section, the offense is:
2424 (1) a state jail felony, if the person is a citizen of
2525 the United States; or
2626 (2) a felony of the third degree, if the person is not
2727 a citizen of the United States.
2828 SECTION 3. The changes in law made by this Act apply only to
2929 an offense committed on or after the effective date of this Act. An
3030 offense committed before the effective date of this Act is governed
3131 by the law in effect on the date the offense was committed, and the
3232 former law is continued in effect for that purpose. For purposes of
3333 this section, an offense was committed before the effective date of
3434 this Act if any element of the offense occurred before that date.
3535 SECTION 4. This Act takes effect December 1, 2017.
