| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 13.007(b), Election Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (b) An offense under this section is a Class B misdemeanor, |
|---|
| 13 | 13 | | unless the person is not a citizen of the United States. In that |
|---|
| 14 | 14 | | case, the offense is a state jail felony. |
|---|
| 15 | 15 | | SECTION 2. Section 64.012, Election Code, is amended by |
|---|
| 16 | 16 | | amending Subsection (b) and adding Subsection (c) to read as |
|---|
| 17 | 17 | | follows: |
|---|
| 18 | 18 | | (b) Except as provided by Subsection (c), an [An] offense |
|---|
| 19 | 19 | | under this section is a felony of the second degree [unless the |
|---|
| 20 | 20 | | person is convicted of an attempt. In that case, the offense is a |
|---|
| 21 | 21 | | state jail felony]. |
|---|
| 22 | 22 | | (c) If a person is convicted of an attempt to commit an |
|---|
| 23 | 23 | | offense under this section, the offense is: |
|---|
| 24 | 24 | | (1) a state jail felony, if the person is a citizen of |
|---|
| 25 | 25 | | the United States; or |
|---|
| 26 | 26 | | (2) a felony of the third degree, if the person is not |
|---|
| 27 | 27 | | a citizen of the United States. |
|---|
| 28 | 28 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 29 | 29 | | an offense committed on or after the effective date of this Act. An |
|---|
| 30 | 30 | | offense committed before the effective date of this Act is governed |
|---|
| 31 | 31 | | by the law in effect on the date the offense was committed, and the |
|---|
| 32 | 32 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 33 | 33 | | this section, an offense was committed before the effective date of |
|---|
| 34 | 34 | | this Act if any element of the offense occurred before that date. |
|---|
| 35 | 35 | | SECTION 4. This Act takes effect December 1, 2017. |
